44 | 44 | | NGENERAL.—Pursuant to section 1730C of 12 |
---|
45 | 45 | | this title and subject to the requirements of title III of 13 |
---|
46 | 46 | | the Controlled Substances Act (21 U.S.C. 801 et seq.), 14 |
---|
47 | 47 | | a covered health care professional may use telemedicine 15 |
---|
48 | 48 | | to deliver, distribute, or dispense to a patient eligible to 16 |
---|
49 | 49 | | receive medical treatment under this chapter a controlled 17 |
---|
50 | 50 | | substance that is a prescription drug as determined under 18 |
---|
51 | 51 | | the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 301 19 |
---|
52 | 52 | | et seq.) regardless of whether such covered health care 20 |
---|
53 | 53 | | professional has conducted an in-person medical examina-21 |
---|
54 | 54 | | tion of such patient if— 22 |
---|
55 | 55 | | ‘‘(1) such covered health care professional is— 23 |
---|
56 | 56 | | ‘‘(A) authorized to prescribe the basic class 24 |
---|
57 | 57 | | of such controlled substance under an active, 25 |

69 | 69 | | regulations guidelines and a process for the delivery, dis-8 |

70 | 70 | | tribution, and dispensation of a controlled substance pur-9 |

71 | 71 | | suant to subsection (a). 10 |

73 | 73 | | ULE OFCONSTRUCTION.—Nothing in this sec-11 |

74 | 74 | | tion may be construed to remove, limit, or otherwise affect 12 |
---|
75 | 75 | | any obligation of a covered health care professional under 13 |
---|
76 | 76 | | the Controlled Substances Act. 14 |
---|
77 | 77 | | ‘‘(d) D |
---|
78 | 78 | | EFINITIONS.— In this section: 15 |
---|
79 | 79 | | ‘‘(1) The terms ‘controlled substance’, ‘deliver’, 16 |
---|
80 | 80 | | ‘dispense’, and ‘distribute’ have the meanings given 17 |
---|
81 | 81 | | such terms in section 102 of the Controlled Sub-18 |
---|
82 | 82 | | stances Act, respectively. 19 |
---|
83 | 83 | | ‘‘(2) The term ‘covered health care professional’ 20 |
---|
84 | 84 | | means— 21 |
---|
85 | 85 | | ‘‘(A) a health care professional who— 22 |
---|
86 | 86 | | ‘‘(i) is an employee of the Department 23 |
---|
87 | 87 | | appointed under section 7306, 7401, 7405, 24 |

88 | 88 | | 7406, or 7408 of this title or under title 5; 25 |

105 | 105 | | ‘‘(vi) with respect to a health care 14 |

106 | 106 | | profession listed under section 7402(b) of 15 |

107 | 107 | | this title, has the qualifications for such 16 |
---|
108 | 108 | | profession as set forth by the Secretary; 17 |

110 | 110 | | ‘‘(B) a health professions trainee who— 19 |

111 | 111 | | ‘‘(i) is appointed under section 7405 20 |
