2727 This Act may be cited as the ‘‘Protecting Veteran Ac-4
2828 cess to Telemedicine Services Act of 2025’’. 5

3737 Subchapter III of chapter 17 of title 38, United 6
3838 States Code, is amended by adding at the end the fol-7
3939 lowing new section (and conforming the table of sections 8
4040 at the beginning of such chapter accordingly): 9
4141 ‘‘§ 1730D. Delivery, distribution, and dispensation of 10
4242 controlled medications via telemedicine 11
4343 ‘‘(a) I
4444 NGENERAL.—Pursuant to section 1730C of 12
4545 this title and subject to the requirements of title III of 13
4646 the Controlled Substances Act (21 U.S.C. 801 et seq.), 14
4747 a covered health care professional may use telemedicine 15
4848 to deliver, distribute, or dispense to a patient eligible to 16
4949 receive medical treatment under this chapter a controlled 17
5050 substance that is a prescription drug as determined under 18
5151 the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 301 19
5252 et seq.) regardless of whether such covered health care 20
5353 professional has conducted an in-person medical examina-21
5454 tion of such patient if— 22
5555 ‘‘(1) such covered health care professional is— 23
5656 ‘‘(A) authorized to prescribe the basic class 24
5757 of such controlled substance under an active, 25

6161 current, full, and unrestricted State license, 1
6262 registration, or certification; and 2
6363 ‘‘(B) acting in the usual course of profes-3
6464 sional practice; and 4
6565 ‘‘(2) such substance is delivered, distributed, or 5
6666 dispensed for a legitimate medical purpose. 6
6767 ‘‘(b) R
6868 EGULATIONS.—The Secretary shall establish in 7
6969 regulations guidelines and a process for the delivery, dis-8
7070 tribution, and dispensation of a controlled substance pur-9
7171 suant to subsection (a). 10
7272 ‘‘(c) R
7373 ULE OFCONSTRUCTION.—Nothing in this sec-11
7474 tion may be construed to remove, limit, or otherwise affect 12
7575 any obligation of a covered health care professional under 13
7676 the Controlled Substances Act. 14
7777 ‘‘(d) D
7878 EFINITIONS.— In this section: 15
7979 ‘‘(1) The terms ‘controlled substance’, ‘deliver’, 16
8080 ‘dispense’, and ‘distribute’ have the meanings given 17
8181 such terms in section 102 of the Controlled Sub-18
8282 stances Act, respectively. 19
8383 ‘‘(2) The term ‘covered health care professional’ 20
8484 means— 21
8585 ‘‘(A) a health care professional who— 22
8686 ‘‘(i) is an employee of the Department 23
8787 appointed under section 7306, 7401, 7405, 24
8888 7406, or 7408 of this title or under title 5; 25

9292 ‘‘(ii) is not a contractor of the De-1
9393 partment; 2
9494 ‘‘(iii) is authorized by the Secretary to 3
9595 provide health care under this chapter; 4
9696 ‘‘(iv) is required to adhere to all 5
9797 standards for quality relating to the provi-6
9898 sion of health care in accordance with ap-7
9999 plicable policies of the Department; 8
100100 ‘‘(v) has an active, current, full, and 9
101101 unrestricted license, registration, or certifi-10
102102 cation or meet qualification standards set 11
103103 forth by the Secretary within a specified 12
104104 time frame; and 13
105105 ‘‘(vi) with respect to a health care 14
106106 profession listed under section 7402(b) of 15
107107 this title, has the qualifications for such 16
108108 profession as set forth by the Secretary; 17
109109 and 18
110110 ‘‘(B) a health professions trainee who— 19
111111 ‘‘(i) is appointed under section 7405 20
112112 of this title; and 21
113113 ‘‘(ii) is under the clinical supervision 22
114114 of a health care professional described in 23
115115 subparagraph (A).’’. 24
