A BILL 
To amend title 38, United States Code, to authorize certain 
heath care professionals employed by the Department 
of Veterans Affairs to deliver, distribute, or dispense 
to veterans certain controlled medications via telemedi-
cine under certain conditions, and for other purposes. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Protecting Veteran Ac-4
cess to Telemedicine Services Act of 2025’’. 5

SEC. 2. DELIVERY, DISTRIBUTION, AND DISPENSATION OF 1
CONTROLLED MEDICATIONS BY COVERED 2
DEPARTMENT OF VETERANS AFFAIRS 3
HEALTH CARE PROFESSIONALS VIA TELE-4
MEDICINE. 5
Subchapter III of chapter 17 of title 38, United 6
States Code, is amended by adding at the end the fol-7
lowing new section (and conforming the table of sections 8
at the beginning of such chapter accordingly): 9
‘‘§ 1730D. Delivery, distribution, and dispensation of 10
controlled medications via telemedicine 11
‘‘(a) I
NGENERAL.—Pursuant to section 1730C of 12
this title and subject to the requirements of title III of 13
the Controlled Substances Act (21 U.S.C. 801 et seq.), 14
a covered health care professional may use telemedicine 15
to deliver, distribute, or dispense to a patient eligible to 16
receive medical treatment under this chapter a controlled 17
substance that is a prescription drug as determined under 18
the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 301 19
et seq.) regardless of whether such covered health care 20
professional has conducted an in-person medical examina-21
tion of such patient if— 22
‘‘(1) such covered health care professional is— 23
‘‘(A) authorized to prescribe the basic class 24
of such controlled substance under an active, 25

current, full, and unrestricted State license, 1
registration, or certification; and 2
‘‘(B) acting in the usual course of profes-3
sional practice; and 4
‘‘(2) such substance is delivered, distributed, or 5
dispensed for a legitimate medical purpose. 6
‘‘(b) R
EGULATIONS.—The Secretary shall establish in 7
regulations guidelines and a process for the delivery, dis-8
tribution, and dispensation of a controlled substance pur-9
suant to subsection (a). 10
‘‘(c) R
ULE OFCONSTRUCTION.—Nothing in this sec-11
tion may be construed to remove, limit, or otherwise affect 12
any obligation of a covered health care professional under 13
the Controlled Substances Act. 14
‘‘(d) D
EFINITIONS.— In this section: 15
‘‘(1) The terms ‘controlled substance’, ‘deliver’, 16
‘dispense’, and ‘distribute’ have the meanings given 17
such terms in section 102 of the Controlled Sub-18
stances Act, respectively. 19
‘‘(2) The term ‘covered health care professional’ 20
means— 21
‘‘(A) a health care professional who— 22
‘‘(i) is an employee of the Department 23
appointed under section 7306, 7401, 7405, 24
7406, or 7408 of this title or under title 5; 25

‘‘(ii) is not a contractor of the De-1
partment; 2
‘‘(iii) is authorized by the Secretary to 3
provide health care under this chapter; 4
‘‘(iv) is required to adhere to all 5
standards for quality relating to the provi-6
sion of health care in accordance with ap-7
plicable policies of the Department; 8
‘‘(v) has an active, current, full, and 9
unrestricted license, registration, or certifi-10
cation or meet qualification standards set 11
forth by the Secretary within a specified 12
time frame; and 13
‘‘(vi) with respect to a health care 14
profession listed under section 7402(b) of 15
this title, has the qualifications for such 16
profession as set forth by the Secretary; 17
and 18
‘‘(B) a health professions trainee who— 19
‘‘(i) is appointed under section 7405 20
of this title; and 21
‘‘(ii) is under the clinical supervision 22
of a health care professional described in 23
subparagraph (A).’’. 24
