---|

68 | 68 | | (2) creates or otherwise provides a majority of 8 |
---|
69 | 69 | | the components used in such battery. 9 |

73 | 73 | | ELATING TO ASSESSMENT .—The Secretary 11 |

75 | 75 | | under subsection (a) if the Secretary assesses in the 13 |

76 | 76 | | affirmative all of the following: 14 |
---|
77 | 77 | | (A) The batteries to be procured do not 15 |
---|
78 | 78 | | pose a national security, data, or infrastructure 16 |
---|
79 | 79 | | risk to the United States. 17 |
---|
80 | 80 | | (B) There is no available alternative to 18 |
---|
81 | 81 | | procure batteries that are— 19 |
---|
82 | 82 | | (i) of similar or better cost and qual-20 |
---|
83 | 83 | | ity; and 21 |
---|
84 | 84 | | (ii) produced by an entity not speci-22 |
---|
85 | 85 | | fied in subsection (b). 23 |
