2121 This Act may be cited as the ‘‘Protect Medicaid Act’’. 4

2929 Section 1903(i) of the Social Security Act (42 U.S.C. 5
3030 1396b(i)) is amended— 6
3131 (1) in paragraph (26), by striking ‘‘; or’’ and 7
3232 inserting a semicolon; 8
3333 (2) in paragraph (27), by striking the period at 9
3434 the end and inserting ‘‘; or’’; and 10
3535 (3) by inserting after paragraph (27) the fol-11
3636 lowing new paragraph: 12
3737 ‘‘(28) with respect to any amounts expended for 13
3838 the administration of a State program associated 14
3939 with providing health benefits to noncitizens who are 15
4040 not lawfully admitted permanent residents and are 16
4141 ineligible for medical assistance under this title on 17
4242 the basis of not having a satisfactory immigration 18
4343 status (as defined in section 1137(d)(1)(B)(iii)) (ex-19
4444 cept that such prohibition shall not be construed as 20
4545 prohibiting payment under the preceding provisions 21
4646 of this section for costs attributable to the establish-22
4747 ment or operation of a system designed to ensure 23
4848 compliance with such prohibition).’’. 24

5353 Not later than 180 days after the date of enactment 2
5454 of this Act, the Inspector General of the Department of 3
5555 Health and Human Services shall submit to Congress a 4
5656 report that includes the following information with respect 5
5757 to States that provide health benefits to noncitizens who 6
5858 are not lawfully admitted permanent residents and are in-7
5959 eligible on the basis of immigration status for medical as-8
6060 sistance under title XIX of the Social Security Act (42 9
6161 U.S.C. 1396 et seq.): 10
6262 (1) How such States separate amounts ex-11
6363 pended on the administrative costs related to the 12
6464 State’s Medicaid program and amounts expended on 13
6565 administrative costs related to providing health ben-14
6666 efits to such noncitizens. 15
6767 (2) The types of procedures, protocols, or sys-16
6868 tems that such States employ to ensure that they 17
6969 are in full compliance with prohibitions on the use 18
7070 of Federal funding to provide health benefits to such 19
7171 noncitizens and how effective they are at ensuring 20
7272 compliance. 21
7373 (3) A description of States’ methods of financ-22
7474 ing State programs that provide health benefits to 23
7575 such noncitizens who are ineligible for medical as-24
7676 sistance due to not having a satisfactory immigra-25
7777 tion status, including through the increased use of 26

8181 provider taxes and intergovernmental transfers to fi-1
8282 nance the non-Federal share of expenditures under 2
8383 the State Medicaid program for medical assistance 3
8484 provided to individuals who are not so ineligible. 4
8585 (4) An analysis of— 5
8686 (A) the extent to which such noncitizens 6
8787 are provided covered outpatient drugs pur-7
8888 chased under— 8
8989 (i) the Medicaid Drug Rebate Pro-9
9090 gram under section 1927 of the Social Se-10
9191 curity Act (42 U.S.C. 1396r–8); or 11
9292 (ii) the drug discount program under 12
9393 section 340B of the Public Health Service 13
9494 Act (42 U.S.C. 256b); and 14
9595 (B) the effect that the provision to such 15
9696 noncitizens of covered outpatient drugs pur-16
9797 chased under the programs described in sub-17
9898 paragraph (A) has on the average manufacturer 18
9999 price (as defined in section 1927(k)(1) of the 19
100100 Social Security Act (42 U.S.C. 1396r–8(k)(1))) 20
101101 of such drugs, including whether the average 21
102102 manufacturer price for such drugs would be 22
103103 lower if no drugs purchased under such pro-23
104104 grams were provided to such noncitizens. 24
