PROHIBITING FEDERAL MEDICAID FUNDING FOR 1 THE ADMINISTRATIVE COSTS OF PROVIDING 2 HEALTH BENEFITS TO INDIVIDUALS WHO 3 ARE UNAUTHORIZED IMMIGRANTS. 4 Section 1903(i) of the Social Security Act (42 U.S.C. 5 1396b(i)) is amended— 6 (1) in paragraph (26), by striking ‘‘; or’’ and 7 inserting a semicolon; 8 (2) in paragraph (27), by striking the period at 9 the end and inserting ‘‘; or’’; and 10 (3) by inserting after paragraph (27) the fol-11 lowing new paragraph: 12 ‘‘(28) with respect to any amounts expended for 13 the administration of a State program associated 14 with providing health benefits to noncitizens who are 15 not lawfully admitted permanent residents and are 16 ineligible for medical assistance under this title on 17 the basis of not having a satisfactory immigration 18 status (as defined in section 1137(d)(1)(B)(iii)) (ex-19 cept that such prohibition shall not be construed as 20 prohibiting payment under the preceding provisions 21 of this section for costs attributable to the establish-22 ment or operation of a system designed to ensure 23 compliance with such prohibition).’’. 24 VerDate Sep 11 2014 18:55 Mar 08, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1195.IH H1195 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •HR 1195 IH SEC. 3. INSPECTOR GENERAL REPORT. 1 Not later than 180 days after the date of enactment 2 of this Act, the Inspector General of the Department of 3 Health and Human Services shall submit to Congress a 4 report that includes the following information with respect 5 to States that provide health benefits to noncitizens who 6 are not lawfully admitted permanent residents and are in-7 eligible on the basis of immigration status for medical as-8 sistance under title XIX of the Social Security Act (42 9 U.S.C. 1396 et seq.): 10 (1) How such States separate amounts ex-11 pended on the administrative costs related to the 12 State’s Medicaid program and amounts expended on 13 administrative costs related to providing health ben-14 efits to such noncitizens. 15 (2) The types of procedures, protocols, or sys-16 tems that such States employ to ensure that they 17 are in full compliance with prohibitions on the use 18 of Federal funding to provide health benefits to such 19 noncitizens and how effective they are at ensuring 20 compliance. 21 (3) A description of States’ methods of financ-22 ing State programs that provide health benefits to 23 such noncitizens who are ineligible for medical as-24 sistance due to not having a satisfactory immigra-25 tion status, including through the increased use of 26 VerDate Sep 11 2014 18:55 Mar 08, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1195.IH H1195 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •HR 1195 IH provider taxes and intergovernmental transfers to fi-1 nance the non-Federal share of expenditures under 2 the State Medicaid program for medical assistance 3 provided to individuals who are not so ineligible. 4 (4) An analysis of— 5 (A) the extent to which such noncitizens 6 are provided covered outpatient drugs pur-7 chased under— 8 (i) the Medicaid Drug Rebate Pro-9 gram under section 1927 of the Social Se-10 curity Act (42 U.S.C. 1396r–8); or 11 (ii) the drug discount program under 12 section 340B of the Public Health Service 13 Act (42 U.S.C. 256b); and 14 (B) the effect that the provision to such 15 noncitizens of covered outpatient drugs pur-16 chased under the programs described in sub-17 paragraph (A) has on the average manufacturer 18 price (as defined in section 1927(k)(1) of the 19 Social Security Act (42 U.S.C. 1396r–8(k)(1))) 20 of such drugs, including whether the average 21 manufacturer price for such drugs would be 22 lower if no drugs purchased under such pro-23 grams were provided to such noncitizens. 24 Æ VerDate Sep 11 2014 18:55 Mar 08, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H1195.IH H1195 kjohnson on DSK7ZCZBW3PROD with $$_JOB
