AN ACT
To amend the Research and Development, Competition, and
Innovation Act to clarify the definition of foreign country
for purposes of malign foreign talent recruitment restric-
tion, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2 2

SECTION 1. SHORT TITLE. 1
This Act may be cited as the ‘‘United States Re-2
search Protection Act’’. 3
SEC. 2. CLARIFICATION OF DEFINITION OF FOREIGN COUN-4
TRY FOR PURPOSES OF MALIGN FOREIGN 5
TALENT RECRUITMENT RESTRICTION. 6
Paragraph (4) of section 10638 of title VI of division 7
B of the Research and Development, Competition, and In-8
novation Act (Public Law 117–167; 42 U.S.C. 19237) is 9
amended— 10
(1) by inserting ‘‘of concern’’ after ‘‘foreign 11
country’’ each place such term appears; 12
(2) by striking ‘‘means—’’ and all that follows 13
through ‘‘any program, position, or activity’’ and in-14
serting ‘‘means any program, position, or activity’’; 15
(3) by striking subparagraph (B); 16
(4) by redesignating clauses (i) through (ix) as 17
subparagraphs (A) through (I), respectively, and 18
moving such subparagraphs, as so redesignated, two 19
ems to the left; 20
(5) in the matter preceding subparagraph (A), 21
as so redesignated, by striking ‘‘directly provided’’ 22
and inserting ‘‘whether directly or indirectly pro-23
vided’’; and 24 3

(6) in subparagraph (I), as so redesignated, by 1
striking ‘‘; and’’ and inserting a period. 2
