2323 This Act may be cited as the ‘‘Healthy Poultry As-4
2424 sistance and Indemnification Act of 2025’’. 5
2525 SEC. 2. COMPENSATION FOR POULTRY GROWERS AND LAY-6

2727 Section 10407 of the Animal Health Protection Act 8

4545 ONTROL AREA.—The term ‘control 8
4646 area’ means a Control Area determined by the 9
4747 Administrator of the Animal and Plant Health 10
4848 Inspection Service. 11
4949 ‘‘(B) P
5050 OULTRY.—The term ‘poultry’ 12
5151 means domesticated fowl that are bred for the 13
5252 primary purpose of producing eggs or meat, in-14
5353 cluding, when so bred, chickens, turkeys, os-15
5454 triches, emus, rheas, cassowaries, waterfowl, 16
5555 and game birds, but not including doves and pi-17
5656 geons. 18

5858 OMPENSATION.— 19
5959 ‘‘(A) I
6060 N GENERAL.—Except as provided in 20
6161 paragraph (3), the Secretary shall compensate 21
6262 the owner of a poultry growing or laying facility 22
6363 for flocks of birds that the owner of such facil-23
6464 ity was prohibited from growing or laying due 24

7171 MOUNT.— 3
7272 ‘‘(i) I
7373 N GENERAL .—Compensation 4
7474 paid under subparagraph (A) shall be in 5
7575 an amount that is equal to the product ob-6
7676 tained by multiplying— 7
7777 ‘‘(I) the average income from the 8
7878 5 most recent flocks of birds that the 9
7979 poultry growing or laying facility grew 10
8080 or laid; and 11
8181 ‘‘(II) the number of flocks of 12
8282 birds that the owner of the poultry 13
8383 growing or laying facility was prohib-14
8484 ited from growing or laying during the 15
8585 period of time in which the control 16
8686 area was in effect. 17
8787 ‘‘(ii) L
8888 IMITATION.—Compensation 18
8989 paid any owner of a poultry growing or 19
9090 laying facility under this subsection shall 20
9191 not exceed the difference between— 21
9292 ‘‘(I) the amount described in 22
9393 clause (i); and 23
9494 ‘‘(II) any compensation received 24
9595 by the owner from a State or other 25

103103 EVIEWABILITY.—The deter-4
104104 mination by the Secretary of the amount 5
105105 to be paid under this subsection shall be 6
106106 final and not subject to judicial review or 7
107107 review by any officer or employee of the 8
108108 Federal Government other than the Sec-9
109109 retary or the designee of the Secretary. 10
110110 ‘‘(C) T
111111 IMING.—Compensation shall be paid 11
112112 under subparagraph (A) not later than 60 days 12
113113 after the date on which the owner of a poultry 13
114114 growing or laying facility submits a request to 14
115115 the Secretary for compensation. 15
116116 ‘‘(3) E
117117 XCEPTIONS.— 16
118118 ‘‘(A) I
119119 N GENERAL.—The exceptions de-17
120120 scribed in subsection (d)(3) shall apply to this 18
121121 subsection. 19

123123 OMPENSATION FOR DESTROYED 20
124124 ANIMALS.—No payment shall be made by the 21
125125 Secretary under this subsection to an owner of 22
126126 a poultry growing or laying facility who has re-23
127127 ceived compensation under subsection (d) for a 24
