17	17	To amend the Animal Health Protection Act to provide com-
18	18	pensation for poultry growers and layers in control areas,
19	19	and for other purposes.
20	20	Be it enacted by the Senate and House of Representa-1
21	21	tives of the United States of America in Congress assembled, 2
22	22	SECTION 1. SHORT TITLE. 3
23	23	This Act may be cited as the ‘‘Healthy Poultry As-4
24	24	sistance and Indemnification Act of 2025’’. 5
25	25	SEC. 2. COMPENSATION FOR POULTRY GROWERS AND LAY-6
26	26	ERS IN CONTROL AREAS. 7
27	27	Section 10407 of the Animal Health Protection Act 8
28	28	(7 U.S.C. 8306) is amended— 9

43	43	EFINITIONS.—In this subsection: 7
44	44	‘‘(A) C
45	45	ONTROL AREA.—The term ‘control 8
46	46	area’ means a Control Area determined by the 9
47	47	Administrator of the Animal and Plant Health 10
48	48	Inspection Service. 11
49	49	‘‘(B) P
50	50	OULTRY.—The term ‘poultry’ 12
51	51	means domesticated fowl that are bred for the 13
52	52	primary purpose of producing eggs or meat, in-14
53	53	cluding, when so bred, chickens, turkeys, os-15
54	54	triches, emus, rheas, cassowaries, waterfowl, 16
55	55	and game birds, but not including doves and pi-17
56	56	geons. 18

58	58	OMPENSATION.— 19
59	59	‘‘(A) I
60	60	N GENERAL.—Except as provided in 20
61	61	paragraph (3), the Secretary shall compensate 21
62	62	the owner of a poultry growing or laying facility 22
63	63	for flocks of birds that the owner of such facil-23
64	64	ity was prohibited from growing or laying due 24

70	70	‘‘(B) A
71	71	MOUNT.— 3
72	72	‘‘(i) I
73	73	N GENERAL .—Compensation 4
74	74	paid under subparagraph (A) shall be in 5
75	75	an amount that is equal to the product ob-6
76	76	tained by multiplying— 7
77	77	‘‘(I) the average income from the 8
78	78	5 most recent flocks of birds that the 9
79	79	poultry growing or laying facility grew 10
80	80	or laid; and 11
81	81	‘‘(II) the number of flocks of 12
82	82	birds that the owner of the poultry 13
83	83	growing or laying facility was prohib-14
84	84	ited from growing or laying during the 15
85	85	period of time in which the control 16
86	86	area was in effect. 17
87	87	‘‘(ii) L
88	88	IMITATION.—Compensation 18
89	89	paid any owner of a poultry growing or 19
90	90	laying facility under this subsection shall 20
91	91	not exceed the difference between— 21
92	92	‘‘(I) the amount described in 22
93	93	clause (i); and 23
94	94	‘‘(II) any compensation received 24
95	95	by the owner from a State or other 25

102	102	‘‘(iii) R
103	103	EVIEWABILITY.—The deter-4
104	104	mination by the Secretary of the amount 5
105	105	to be paid under this subsection shall be 6
106	106	final and not subject to judicial review or 7
107	107	review by any officer or employee of the 8
108	108	Federal Government other than the Sec-9
109	109	retary or the designee of the Secretary. 10
110	110	‘‘(C) T
111	111	IMING.—Compensation shall be paid 11
112	112	under subparagraph (A) not later than 60 days 12
113	113	after the date on which the owner of a poultry 13
114	114	growing or laying facility submits a request to 14
115	115	the Secretary for compensation. 15
116	116	‘‘(3) E
117	117	XCEPTIONS.— 16
118	118	‘‘(A) I
119	119	N GENERAL.—The exceptions de-17
120	120	scribed in subsection (d)(3) shall apply to this 18
121	121	subsection. 19

123	123	OMPENSATION FOR DESTROYED 20
124	124	ANIMALS.—No payment shall be made by the 21
125	125	Secretary under this subsection to an owner of 22
126	126	a poultry growing or laying facility who has re-23
127	127	ceived compensation under subsection (d) for a 24
