A BILL
To amend the Animal Health Protection Act to provide com-
pensation for poultry growers and layers in control areas,
and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Healthy Poultry As-4
sistance and Indemnification Act of 2025’’. 5
SEC. 2. COMPENSATION FOR POULTRY GROWERS AND LAY-6
ERS IN CONTROL AREAS. 7
Section 10407 of the Animal Health Protection Act 8
(7 U.S.C. 8306) is amended— 9

‘‘(1) D
EFINITIONS.—In this subsection: 7
‘‘(A) C
ONTROL AREA.—The term ‘control 8
area’ means a Control Area determined by the 9
Administrator of the Animal and Plant Health 10
Inspection Service. 11
‘‘(B) P
OULTRY.—The term ‘poultry’ 12
means domesticated fowl that are bred for the 13
primary purpose of producing eggs or meat, in-14
cluding, when so bred, chickens, turkeys, os-15
triches, emus, rheas, cassowaries, waterfowl, 16
and game birds, but not including doves and pi-17
geons. 18
‘‘(2) C
OMPENSATION.— 19
‘‘(A) I
N GENERAL.—Except as provided in 20
paragraph (3), the Secretary shall compensate 21
the owner of a poultry growing or laying facility 22
for flocks of birds that the owner of such facil-23
ity was prohibited from growing or laying due 24

to the location of the facility within a control 1
area. 2
‘‘(B) A
MOUNT.— 3
‘‘(i) I
N GENERAL .—Compensation 4
paid under subparagraph (A) shall be in 5
an amount that is equal to the product ob-6
tained by multiplying— 7
‘‘(I) the average income from the 8
5 most recent flocks of birds that the 9
poultry growing or laying facility grew 10
or laid; and 11
‘‘(II) the number of flocks of 12
birds that the owner of the poultry 13
growing or laying facility was prohib-14
ited from growing or laying during the 15
period of time in which the control 16
area was in effect. 17
‘‘(ii) L
IMITATION.—Compensation 18
paid any owner of a poultry growing or 19
laying facility under this subsection shall 20
not exceed the difference between— 21
‘‘(I) the amount described in 22
clause (i); and 23
‘‘(II) any compensation received 24
by the owner from a State or other 25

source for the 1 or more flocks of 1
birds that the owner was prohibited 2
from growing or laying. 3
‘‘(iii) R
EVIEWABILITY.—The deter-4
mination by the Secretary of the amount 5
to be paid under this subsection shall be 6
final and not subject to judicial review or 7
review by any officer or employee of the 8
Federal Government other than the Sec-9
retary or the designee of the Secretary. 10
‘‘(C) T
IMING.—Compensation shall be paid 11
under subparagraph (A) not later than 60 days 12
after the date on which the owner of a poultry 13
growing or laying facility submits a request to 14
the Secretary for compensation. 15
‘‘(3) E
XCEPTIONS.— 16
‘‘(A) I
N GENERAL.—The exceptions de-17
scribed in subsection (d)(3) shall apply to this 18
subsection. 19
‘‘(B) C
OMPENSATION FOR DESTROYED 20
ANIMALS.—No payment shall be made by the 21
Secretary under this subsection to an owner of 22
a poultry growing or laying facility who has re-23
ceived compensation under subsection (d) for a 24

facility in the same control area during the 1
