4040 N GENERAL.—In the case of an agree-11
4141 ment entered into under subsection (b)(1) that ad-12
4242 dresses diminished quantity and quality of wetland 13
4343 wildlife habitats, the Secretary, in consultation with 14
4444 the applicable State technical committee established 15
4545 under section 1261(a), may— 16
4646 ‘‘(A) enroll other agricultural land that is 17
4747 not eligible land on which the resource concerns 18
4848 identified in the agreement can be addressed if 19
4949 the enrollment of such other agricultural land is 20
5050 critical to the accomplishment of the purposes 21
5151 of the agreement; 22
5252 ‘‘(B) if the agreement involves the mainte-23
5353 nance of habitat for one or more wetland-de-24
5454 pendent species on working cropland, permit 25
5555 seasonally flooded agricultural uses on such 26

5959 working cropland with the adoption of at least 1
6060 one best management practice; and 2
6161 ‘‘(C) calculate annual rental payments in a 3
6262 manner that— 4
6363 ‘‘(i) is comparable with annual costs 5
6464 to maintain other seasonally-flooded wet-6
6565 land wildlife habitats in the region; and 7
6666 ‘‘(ii) ensures regional consistency in 8
6767 those rental payment rates. 9

6969 ATCHING REQUIREMENT WAIVER .—In 10
7070 the case of an agreement described in paragraph (1), 11
7171 the Secretary may waive the matching requirement 12
7272 described in subsection (c)(1).’’. 13
