To amend the Food Security Act of 1985 to allow for addi-
tional agricultural lands to be enrolled under the con-
servation reserve enhancement program, and for other
purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Pacific Flyway Habitat 4
Enhancement Act’’. 5

Section 1231A of the Food Security Act of 1985 is 3
amended— 4
(1) by redesignating subsection (f) as sub-5
section (g); and 6
(2) by inserting after subsection (e) the fol-7
lowing: 8

TATCONSERVATIONAGREEMENTS.— 10
‘‘(1) I
N GENERAL.—In the case of an agree-11
ment entered into under subsection (b)(1) that ad-12
dresses diminished quantity and quality of wetland 13
wildlife habitats, the Secretary, in consultation with 14
the applicable State technical committee established 15
under section 1261(a), may— 16
‘‘(A) enroll other agricultural land that is 17
not eligible land on which the resource concerns 18
identified in the agreement can be addressed if 19
the enrollment of such other agricultural land is 20
critical to the accomplishment of the purposes 21
of the agreement; 22
‘‘(B) if the agreement involves the mainte-23
nance of habitat for one or more wetland-de-24
pendent species on working cropland, permit 25
seasonally flooded agricultural uses on such 26

working cropland with the adoption of at least 1
one best management practice; and 2
‘‘(C) calculate annual rental payments in a 3
manner that— 4
‘‘(i) is comparable with annual costs 5
to maintain other seasonally-flooded wet-6
land wildlife habitats in the region; and 7
‘‘(ii) ensures regional consistency in 8
those rental payment rates. 9
‘‘(2) M
ATCHING REQUIREMENT WAIVER .—In 10
the case of an agreement described in paragraph (1), 11
the Secretary may waive the matching requirement 12
described in subsection (c)(1).’’. 13
