2424 This Act may be cited as the ‘‘Promoting Responsible 4

3232 SEC. 2. INCLUSION OF VIRTUAL DIABETES PREVENTION 3

3535 (a) I
3636 NGENERAL.—Not later than January 1, 2026, 6
3737 the Secretary shall revise the regulations under parts 410 7
3838 and 424 of title 42, Code of Federal Regulations, to pro-8
3939 vide that, for the period beginning January 1, 2026, and 9
4040 ending December 31, 2030— 10
4141 (1) an entity may participate in the MDPP by 11
4242 offering only online MDPP services via synchronous 12
4343 or asynchronous technology or telecommunications if 13
4444 such entity meets the conditions for enrollment as 14
4545 an MDPP supplier (as specified in section 15
4646 424.205(b) of title 42, Code of Federal Regulations 16
4747 (or a successor regulation)); 17
4848 (2) if an entity participates in the MDPP in the 18
4949 manner described in paragraph (1)— 19
5050 (A) the administrative location of such en-20
5151 tity shall be the address of the entity on file 21
5252 under the Diabetes Prevention Recognition Pro-22
5353 gram; and 23
5454 (B) in the case of online MDPP services 24
5555 furnished by such entity to an MDPP bene-25

6161 nished, the entity shall not be prohibited from 3
6262 submitting a claim for payment for such serv-4
6363 ices solely by reason of the location of such ben-5
6464 eficiary at such time; and 6
6565 (3) no limit is applied on the number of times 7
6666 an individual may enroll in the MDPP. 8

6868 EFINITIONS.—In this section: 9
6969 (1) MDPP.—The term ‘‘MDPP’’ means the 10
7070 Medicare Diabetes Prevention Program conducted 11
7171 under section 1115A of the Social Security Act (42 12
7272 U.S.C. 1315a), as described in the final rule pub-13
7373 lished in the Federal Register entitled ‘‘Medicare 14
7474 and Medicaid Programs; CY 2024 Payment Policies 15
7575 Under the Physician Fee Schedule and Other 16
7676 Changes to Part B Payment and Coverage Policies; 17
7777 Medicare Shared Savings Program Requirements; 18
7878 Medicare Advantage; Medicare and Medicaid Pro-19
7979 vider and Supplier Enrollment Policies; and Basic 20
8080 Health Program’’ (88 Fed. Reg. 78818 (November 21
8181 16, 2023)) (or a successor regulation). 22
