1515 Be it enacted by the Senate and House of Representa-1
1616 tives of the United States of America in Congress assembled, 2
1717 SECTION 1. SHORT TITLE. 3
1818 This Act may be cited as the ‘‘Providing Responsible 4
1919 Oversight and Transparency and Ensuring Collegiate 5
2020 Trust for Student Athletes Act’’ or the ‘‘PROTECT Stu-6
2121 dent Athletes Act’’. 7
2222 SEC. 2. FINDINGS. 8
2323 Congress finds the following: 9

2727 (1) The practice of sports betting, including 1
2828 proposition bets involving the performance of stu-2
2929 dent athletes, constitutes a substantial part of inter-3
3030 state commerce. 4
3131 (2) Sports betting activities are conducted 5
3232 across State lines by various means, including online 6
3333 platforms and physical betting establishments, that 7
3434 involve participants from multiple States. 8
3535 (3) The economic impact of sports betting on 9
3636 intercollegiate sports extends beyond State borders 10
3737 and affects the national economy, including through 11
3838 revenue relating to advertising, broadcasting rights, 12
3939 and other commercial activities linked to intercolle-13
4040 giate sports. 14
4141 (4) Ensuring the welfare of student athletes is 15
4242 a national concern and regulation of betting prac-16
4343 tices, particularly those involving the performance of 17
4444 student athletes, is essential to safeguard the integ-18
4545 rity, well-being, and educational environments of 19
4646 such athletes. 20
4747 (5) The Federal Government has the authority 21
4848 under the Commerce Clause of the Constitution to 22
4949 regulate interstate commerce and, given the inter-23
5050 state nature of sports betting, Federal regulation is 24

5959 ROHIBITION.—No individual or entity engaged 5
6060 in the business of betting or wagering may accept any bet 6
6161 or wager that includes a covered prop bet. 7

6666 NFAIR OR DECEPTIVE ACTS OR PRAC -10
6767 TICES.—A violation of this section shall be treated 11
6868 as a violation of a regulation under section 12
6969 18(a)(1)(B) of the Federal Trade Commission Act 13
7070 (15 U.S.C. 57a(a)(1)(B)) regarding unfair or decep-14
7171 tive acts or practices. 15

7373 OWERS OF COMMISSION .—The Federal 16
7474 Trade Commission shall enforce this section in the 17
7575 same manner, by the same means, and with the 18
7676 same jurisdiction, powers, and duties as though all 19
7777 applicable terms and provisions of the Federal Trade 20
7878 Commission Act (15 U.S.C. 41 et seq.) were incor-21
7979 porated into and made a part of this section. Any 22
8080 person who violates this section shall be subject to 23
8181 the penalties and entitled to the privileges and im-24

8888 EFINITIONS.—In this section: 3
8989 (1) C
9090 OVERED PROP BET .—The term ‘‘covered 4
9191 prop bet’’ means a bet or wager on the occurrence 5
9292 or non-occurrence, with respect to an intercollegiate 6
9393 sporting event, of an action or achievement by a stu-7
9494 dent athlete that may or may not have a direct bear-8
9595 ing on the final result of any such sporting event. 9

9797 NTERCOLLEGIATE SPORTING EVENT .—The 10
9898 term ‘‘intercollegiate sporting event’’ means a sport-11
9999 ing event played at the collegiate level for which eli-12
100100 gibility requirements for participation by a student 13
101101 athlete are established by a national association for 14
102102 the promotion or regulation of college athletics. 15

104104 TUDENT ATHLETE .—The term ‘‘student 16
105105 athlete’’ means an individual who engages in any 17
106106 intercollegiate sporting event. 18
