167167 standing any other provision of law, and except as pro-9
168168 vided in section 104(c)(2), an alien shall be considered, 10
169169 at the time of obtaining the status of an alien lawfully 11

177177 EQUIREMENTS.— 4
178178 (1) I
179179 N GENERAL.—Notwithstanding any other 5
180180 provision of law, the Secretary or the Attorney Gen-6
181181 eral shall adjust to the status of an alien lawfully 7
182182 admitted for permanent residence on a conditional 8
183183 basis, or without the conditional basis as provided in 9
184184 section 104(c)(2), an alien who is inadmissible or de-10
185185 portable from the United States, is subject to a 11
186186 grant of Deferred Enforced Departure, has tem-12
187187 porary protected status under section 244 of the Im-13
188188 migration and Nationality Act (8 U.S.C. 1254a), or 14
189189 is the son or daughter of an alien admitted as a non-15
190190 immigrant under subparagraph (E)(i), (E)(ii), 16
191191 (H)(i)(b), or (L) of section 101(a)(15) of such Act 17
192192 (8 U.S.C. 1101(a)(15)) if— 18
193193 (A) the alien has been continuously phys-19
194194 ically present in the United States since Janu-20
195195 ary 1, 2021; 21
196196 (B) the alien was 18 years of age or 22
197197 younger on the date on which the alien entered 23
198198 the United States and has continuously resided 24
199199 in the United States since such entry; 25

204204 (i) subject to paragraph (2), is not in-2
205205 admissible under paragraph (1), (6)(E), 3
206206 (6)(G), (8), or (10) of section 212(a) of 4
207207 the Immigration and Nationality Act (8 5
208208 U.S.C. 1182(a)); 6
209209 (ii) has not ordered, incited, assisted, 7
210210 or otherwise participated in the persecution 8
211211 of any person on account of race, religion, 9
212212 nationality, membership in a particular so-10
213213 cial group, or political opinion; and 11
214214 (iii) is not barred from adjustment of 12
215215 status under this title based on the crimi-13
216216 nal and national security grounds de-14
217217 scribed under subsection (c), subject to the 15
218218 provisions of such subsection; and 16
219219 (D) the alien— 17
220220 (i) has been admitted to an institution 18
221221 of higher education; 19
222222 (ii) has been admitted to an area ca-20
223223 reer and technical education school at the 21
224224 postsecondary level; 22
225225 (iii) in the United States, has ob-23
226226 tained— 24

252252 equivalence diploma examination, or 23
253253 other similar State-authorized exam; 24

262262 secondary credential. 6

264264 AIVER OF GROUNDS OF INADMIS -7
265265 SIBILITY.—With respect to any benefit under this 8
266266 title, and in addition to the waivers under subsection 9
267267 (c)(2), the Secretary may waive the grounds of inad-10
268268 missibility under paragraph (1), (6)(E), (6)(G), or 11
269269 (10)(D) of section 212(a) of the Immigration and 12
270270 Nationality Act (8 U.S.C. 1182(a)) for humanitarian 13
271271 purposes, for family unity, or because the waiver is 14
272272 otherwise in the public interest. 15
273273 (3) A
274274 PPLICATION FEE.— 16
275275 (A) I
276276 N GENERAL.—The Secretary may, 17
277277 subject to an exemption under section 303(c), 18
278278 require an alien applying under this section to 19
279279 pay a reasonable fee that is commensurate with 20
280280 the cost of processing the application but does 21
281281 not exceed $495.00. 22

283283 PECIAL PROCEDURES FOR APPLI -23
284284 CANTS WITH DACA.—The Secretary shall estab-24
285285 lish a streamlined procedure for aliens who have 25

289289 been granted DACA and who meet the require-1
290290 ments for renewal (under the terms of the pro-2
291291 gram in effect on January 1, 2017) to apply for 3
292292 adjustment of status to that of an alien lawfully 4
293293 admitted for permanent residence on a condi-5
294294 tional basis under this section, or without the 6
295295 conditional basis as provided in section 7
296296 104(c)(2). Such procedure shall not include a 8
297297 requirement that the applicant pay a fee, except 9
298298 that the Secretary may require an applicant 10
299299 who meets the requirements for lawful perma-11
300300 nent residence without the conditional basis 12
301301 under section 104(c)(2) to pay a fee that is 13
302302 commensurate with the cost of processing the 14
303303 application, subject to the exemption under sec-15
304304 tion 303(c). 16

306306 ACKGROUND CHECKS .—The Secretary 17
307307 may not grant an alien permanent resident status on 18
308308 a conditional basis under this section until the re-19
309309 quirements of section 302 are satisfied. 20
310310 (5) M
311311 ILITARY SELECTIVE SERVICE .—An alien 21
312312 applying for permanent resident status on a condi-22
313313 tional basis under this section, or without the condi-23
314314 tional basis as provided in section 104(c)(2), shall 24
315315 establish that the alien has registered under the 25

321321 such Act. 3

323323 RIMINAL ANDNATIONALSECURITYBARS.— 4

325325 ROUNDS OF INELIGIBILITY .—Except as 5
326326 provided in paragraph (2), an alien is ineligible for 6
327327 adjustment of status under this title (whether on a 7
328328 conditional basis or without the conditional basis as 8
329329 provided in section 104(c)(2)) if any of the following 9
330330 apply: 10
331331 (A) The alien is inadmissible under para-11
332332 graph (2) or (3) of section 212(a) of the Immi-12
333333 gration and Nationality Act (8 U.S.C. 1182(a)). 13
334334 (B) Excluding any offense under State law 14
335335 for which an essential element is the alien’s im-15
336336 migration status, and any minor traffic offense, 16
337337 the alien has been convicted of— 17
338338 (i) any felony offense; 18
339339 (ii) three or more misdemeanor of-19
340340 fenses (excluding simple possession of can-20
341341 nabis or cannabis-related paraphernalia, 21
342342 any offense involving cannabis or cannabis- 22
343343 related paraphernalia which is no longer 23
344344 prosecutable in the State in which the con-24
345345 viction was entered, and any offense involv-25

350350 occurring on the same date, and not aris-2
351351 ing out of the same act, omission, or 3
352352 scheme of misconduct; or 4
353353 (iii) a misdemeanor offense of domes-5
354354 tic violence, unless the alien demonstrates 6
355355 that such crime is related to the alien hav-7
356356 ing been— 8
357357 (I) a victim of domestic violence, 9
358358 sexual assault, stalking, child abuse or 10
359359 neglect, abuse or neglect in later life, 11
360360 or human trafficking; 12
361361 (II) battered or subjected to ex-13
362362 treme cruelty; or 14
363363 (III) a victim of criminal activity 15
364364 described in section 101(a)(15)(U)(iii) 16
365365 of the Immigration and Nationality 17
366366 Act (8 U.S.C. 1101(a)(15)(U)(iii)). 18

368368 AIVERS FOR CERTAIN MISDEMEANORS .— 19
369369 For humanitarian purposes, family unity, or if oth-20
370370 erwise in the public interest, the Secretary may— 21
371371 (A) waive the grounds of inadmissibility 22
372372 under subparagraphs (A), (C), and (D) of sec-23
373373 tion 212(a)(2) of the Immigration and Nation-24
374374 ality Act (8 U.S.C. 1182(a)(2)), unless the con-25

382382 (B) for purposes of clauses (ii) and (iii) of 5
383383 paragraph (1)(B), waive consideration of— 6
384384 (i) one misdemeanor offense if the 7
385385 alien has not been convicted of any offense 8
386386 in the 5-year period preceding the date on 9
387387 which the alien applies for adjustment of 10
388388 status under this title; or 11
389389 (ii) up to two misdemeanor offenses if 12
390390 the alien has not been convicted of any of-13
391391 fense in the 10-year period preceding the 14
392392 date on which the alien applies for adjust-15
393393 ment of status under this title. 16

398398 N GENERAL.—Notwithstanding an 19
399399 alien’s eligibility for adjustment of status under 20
400400 this title, and subject to the procedures de-21
401401 scribed in this paragraph, the Secretary may, 22
402402 as a matter of non-delegable discretion, provi-23
403403 sionally deny an application for adjustment of 24
404404 status (whether on a conditional basis or with-25

412412 the alien is described in subparagraph (B) or 5

415415 UBLIC SAFETY.—An alien is de-7
416416 scribed in this subparagraph if— 8
417417 (i) excluding simple possession of can-9
418418 nabis or cannabis-related paraphernalia, 10
419419 any offense involving cannabis or cannabis- 11
420420 related paraphernalia which is no longer 12
421421 prosecutable in the State in which the con-13
422422 viction was entered, any offense under 14
423423 State law for which an essential element is 15
424424 the alien’s immigration status, any offense 16
425425 involving civil disobedience without vio-17
426426 lence, and any minor traffic offense, the 18
427427 alien— 19
428428 (I) has been convicted of a mis-20
429429 demeanor offense punishable by a 21
430430 term of imprisonment of more than 22
431431 30 days; or 23
432432 (II) has been adjudicated delin-24
433433 quent in a State or local juvenile court 25
