32 | 32 | | effect wage rate required to be paid under section 4 |

33 | 33 | | 655.1308 of title 20, Code of Federal Regulations, to non-5 |

34 | 34 | | immigrants admitted under section 101(a)(15)(H)(ii)(a) 6 |

35 | 35 | | of the Immigration and Nationality Act (8 U.S.C. 7 |
---|
36 | 36 | | 1101(a)(15)(H)(ii)(a)), that was in effect in a State on 8 |
---|
37 | 37 | | December 31, 2023, remains the adverse effect wage rate 9 |
---|
38 | 38 | | for such employees in that State through December 31, 10 |

40 | 40 | | SEC. 3. CLARIFICATION OF JOB CLASSIFICATION. 12 |

41 | 41 | | For the purposes of determining the wage required 13 |

42 | 42 | | to be paid referred to in section 2, the Secretary of Labor 14 |

43 | 43 | | shall utilize a primary duties evaluation for such employ-15 |
---|
