MODIFIED IMPLEMENTATION OF ADVERSE EFFECT 1 WAGE RATE FOR H–2A NONIMMIGRANTS. 2 The Secretary of Labor shall ensure that the adverse 3 effect wage rate required to be paid under section 4 655.1308 of title 20, Code of Federal Regulations, to non-5 immigrants admitted under section 101(a)(15)(H)(ii)(a) 6 of the Immigration and Nationality Act (8 U.S.C. 7 1101(a)(15)(H)(ii)(a)), that was in effect in a State on 8 December 31, 2023, remains the adverse effect wage rate 9 for such employees in that State through December 31, 10 2026. 11 SEC. 3.
