2121 This Act may be cited as the ‘‘USPS Subpoena Au-4

2323 SEC. 2. UNITED STATES POSTAL SERVICE ADMINISTRATIVE 6
2424 SUBPOENA AUTHORITY. 7
2525 Section 3016(a)(1) of title 39, United States Code, 8

3434 ‘‘(A) I
3535 N GENERAL.—In any investigation 5
3636 relating to a covered offense, the Postmaster 6
3737 General may issue in writing and cause to be 7
3838 served a subpoena requiring the production and 8
3939 testimony described in subparagraph (B). In 9
4040 this subparagraph, the term ‘covered offense’ 10
4141 means a violation of— 11
4242 ‘‘(i) any section in this chapter; 12
4343 ‘‘(ii) any section of chapter 83 of title 13
4444 18 insofar as such violation involves the 14
4545 use of the mails; 15
4646 ‘‘(iii) any other provision of law enu-16
4747 merated in section 3001(a); or 17
4848 ‘‘(iv) the Controlled Substances Act 18
4949 (21 U.S.C. 801 et seq.), insofar as such 19
5050 violation involves the use of the mails. 20

6060 cluding books, papers, documents, and 2
6161 other tangible things that constitute or 3
6262 contain evidence) that the Postmaster Gen-4
6363 eral considers relevant or material to such 5
6464 investigation; and 6
6565 ‘‘(ii) testimony by the custodian of the 7
6666 things required to be produced concerning 8
6767 the production and authenticity of those 9
6868 things. 10
6969 ‘‘(C) A
7070 PPLICATION.—A subpoena issued in 11
7171 connection with an investigation under section 12
7272 3005(a) shall not require testimony as set forth 13
7373 in subparagraph (B)(ii).’’; and 14
7474 (3) in subparagraph (D), as redesignated by 15
7575 paragraph (1) of this section, by amending clause 16
7676 (iii) to read as follows: 17
7777 ‘‘(iii) delegation of subpoena approval 18
7878 authority be limited to the Postal Service’s 19
7979 General Counsel, a Deputy General Coun-20
