A BILL
To amend title 39, United States Code, to enhance the
administrative subpoena authority of the United States
Postal Service, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘USPS Subpoena Au-4
thority Act’’. 5
SEC. 2. UNITED STATES POSTAL SERVICE ADMINISTRATIVE 6
SUBPOENA AUTHORITY. 7
Section 3016(a)(1) of title 39, United States Code, 8
is amended— 9

(1) by redesignating subparagraph (B) as sub-1
paragraph (D); 2
(2) by striking subparagraph (A) and inserting 3
the following: 4
‘‘(A) I
N GENERAL.—In any investigation 5
relating to a covered offense, the Postmaster 6
General may issue in writing and cause to be 7
served a subpoena requiring the production and 8
testimony described in subparagraph (B). In 9
this subparagraph, the term ‘covered offense’ 10
means a violation of— 11
‘‘(i) any section in this chapter; 12
‘‘(ii) any section of chapter 83 of title 13
18 insofar as such violation involves the 14
use of the mails; 15
‘‘(iii) any other provision of law enu-16
merated in section 3001(a); or 17
‘‘(iv) the Controlled Substances Act 18
(21 U.S.C. 801 et seq.), insofar as such 19
violation involves the use of the mails. 20
‘‘(B) P
RODUCTION AND TESTIMONY .—Ex-21
cept as provided in subparagraph (C), a sub-22
poena issued under subparagraph (A) may re-23
quire— 24

‘‘(i) the production of any records (in-1
cluding books, papers, documents, and 2
other tangible things that constitute or 3
contain evidence) that the Postmaster Gen-4
eral considers relevant or material to such 5
investigation; and 6
‘‘(ii) testimony by the custodian of the 7
things required to be produced concerning 8
the production and authenticity of those 9
things. 10
‘‘(C) A
PPLICATION.—A subpoena issued in 11
connection with an investigation under section 12
3005(a) shall not require testimony as set forth 13
in subparagraph (B)(ii).’’; and 14
(3) in subparagraph (D), as redesignated by 15
paragraph (1) of this section, by amending clause 16
(iii) to read as follows: 17
‘‘(iii) delegation of subpoena approval 18
authority be limited to the Postal Service’s 19
General Counsel, a Deputy General Coun-20
sel, or the Chief Postal Inspector.’’. 21
