SHORT TITLE. 3 This Act may be cited as the ‘‘Judicial Understaffing 4 Delays Getting Emergencies Solved Act of 2025’’ or the 5 ‘‘JUDGES Act of 2025’’. 6 SEC. 2. FINDINGS. 7 Congress finds the following: 8 VerDate Sep 11 2014 19:02 Mar 12, 2025 Jkt 059200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H1702.IH H1702 ssavage on LAPJG3WLY3PROD with BILLS 2 •HR 1702 IH (1) Article III of the Constitution of the United 1 States gives Congress the power to establish judge-2 ships in the district courts of the United States. 3 (2) Congress has not created a new district 4 court judgeship since 2003 and has not enacted 5 comprehensive judgeship legislation since 1990. 6 (3) This represents the longest period of time 7 since district courts of the United States were estab-8 lished in 1789 that Congress has not authorized any 9 new permanent district court judgeships. 10 (4) By the end of fiscal year 2022, filings in the 11 district courts of the United States had increased by 12 30 percent since the last comprehensive judgeship 13 legislation. 14 (5) As of March 31, 2023, there were 686,797 15 pending cases in the district courts of the United 16 States, with an average of 491 weighted case filings 17 per judgeship over a 12-month period. 18 (6) To deal with increased filings in the district 19 courts of the United States, the Judicial Conference 20 of the United States requested the creation of 66 21 new district court judgeships in its 2023 report. 22 SEC. 3. (C) EFFECTIVE DATE.—This paragraph 11 shall take effect on January 21, 2035. 12 (b) T EMPORARYJUDGESHIPS.— 13 VerDate Sep 11 2014 19:02 Mar 12, 2025 Jkt 059200 PO 00000 Frm 00016 Fmt 6652 Sfmt 6201 E:\BILLS\H1702.IH H1702 ssavage on LAPJG3WLY3PROD with BILLS 17 •HR 1702 IH (1) IN GENERAL.—The President shall appoint, 1 by and with the advice and consent of the Senate, 2 1 additional district judge for the eastern district of 3 Oklahoma. 4 (2) V ACANCIES NOT FILLED .—The first va-5 cancy in the office of district judge in each of the 6 offices of district judge authorized by this sub-7 section, occurring 5 years or more after the con-8 firmation date of the judge named to fill the tem-9 porary district judgeship created in the applicable 10 district by this subsection, shall not be filled. 11 (3) E FFECTIVE DATE.—This subsection shall 12 take effect on the date of the enactment of this Act. 13 (c) A UTHORIZATION OFAPPROPRIATIONS.— 14 (1) I N GENERAL.—There is authorized to be 15 appropriated to carry out this section and the 16 amendments made by this section— 17 (A) for each of fiscal years 2025 and 2026, 18 $12,965,330; 19 (B) for each of fiscal years 2027 and 20 2028, $23,152,375; 21 (C) for each of fiscal years 2029 and 2030, 22 $32,413,325; 23 (D) for each of fiscal years 2031 and 24 2032, $42,600,370; 25 VerDate Sep 11 2014 19:02 Mar 12, 2025 Jkt 059200 PO 00000 Frm 00017 Fmt 6652 Sfmt 6201 E:\BILLS\H1702.IH H1702 ssavage on LAPJG3WLY3PROD with BILLS 18 •HR 1702 IH (E) for each of fiscal years 2033 and 1 2034, $51,861,320; and 2 (F) for fiscal year 2035 and each fiscal 3 year thereafter, $61,122,270. 4 (2) I NFLATION ADJUSTMENT .—For each fiscal 5 year described in paragraph (1), the amount author-6 ized to be appropriated for such fiscal year shall be 7 increased by the percentage by which— 8 (A) the Consumer Price Index for the pre-9 vious fiscal year, exceeds 10 (B) the Consumer Price Index for the fis-11 cal year preceding the fiscal year described in 12 subparagraph (A). 13 (3) D EFINITION.—In this subsection, the term 14 ‘‘Consumer Price Index’’ means the Consumer Price 15 Index for All Urban Consumers (all items, United 16 States city average), published by the Bureau of 17 Labor Statistics of the Department of Labor. 18 SEC. 4. GAO REPORTS. 5 (a) J UDICIALCASELOADS.—Not later than 2 years 6 after the date of enactment of this Act, the Comptroller 7 General of the United States shall submit to the Com-8 mittee on the Judiciary of the Senate and the Committee 9 on the Judiciary of the House of Representatives and 10 make publicly available reports— 11 (1) evaluating— 12 (A) the accuracy and objectiveness of case- 13 related workload measures and methodologies 14 used by the Administrative Office of the United 15 States Courts for district courts of the United 16 States and courts of appeals of the United 17 States; 18 (B) the impact of non-case-related activi-19 ties of judges of the district courts of the 20 United States and courts of appeals of the 21 United States on judicial caseloads; and 22 (C) the effectiveness and efficiency of the 23 policies of the Administrative Office of the 24 United States Courts regarding senior judges; 25 and 26 VerDate Sep 11 2014 19:02 Mar 12, 2025 Jkt 059200 PO 00000 Frm 00019 Fmt 6652 Sfmt 6201 E:\BILLS\H1702.IH H1702 ssavage on LAPJG3WLY3PROD with BILLS 20 •HR 1702 IH (2) providing any recommendations of the 1 Comptroller General with respect to the matters de-2 scribed in paragraph (1). 3 (b) D ETENTIONSPACE.—The Comptroller General of 4 the United States shall submit to the Committee on the 5 Judiciary of the Senate and the Committee on the Judici-6 ary of the House of Representatives a report on an assess-7 ment of— 8 (1) a determination of the needs of Federal 9 agencies for detention space; 10 (2) efforts by Federal agencies to acquire de-11 tention space; and 12 (3) any challenges in determining and acquiring 13 detention space. 14 SEC. 7.
