17	17	To amend the Homeland Security Act of 2002 to direct
18	18	the Under Secretary for Intelligence and Analysis of
19	19	the Department of Homeland Security to conduct an
20	20	annual audit of the information systems and bulk data
21	21	of the Office of Intelligence and Analysis of the Depart-
22	22	ment, and for other purposes.
23	23	Be it enacted by the Senate and House of Representa-1
24	24	tives of the United States of America in Congress assembled, 2
25	25	SECTION 1. SHORT TITLE. 3
26	26	This Act may be cited as the ‘‘DHS Intelligence and 4
27	27	Analysis Oversight and Transparency Act’’. 5

34	34	(a) I
35	35	NGENERAL.—Subtitle A of title II of the Home-4
36	36	land Security Act of 2002 (6 U.S.C. 121 et seq.) is amend-5
37	37	ed by adding at the end the following: 6
38	38	‘‘SEC. 210H. ANNUAL AUDIT OF INFORMATION SYSTEMS 7
39	39	AND BULK DATA. 8
40	40	‘‘(a) D
41	41	EFINITIONS.—In this section: 9
42	42	‘‘(1) A
43	43	PPROPRIATE CONGRESSIONAL COMMIT -10
44	44	TEES.—The term ‘appropriate congressional com-11
45	45	mittees’ means the Committee on Homeland Secu-12
46	46	rity and Governmental Affairs and the Select Com-13
47	47	mittee on Intelligence of the Senate and the Com-14
48	48	mittee on Homeland Security and the Permanent 15
49	49	Select Committee on Intelligence of the House of 16
50	50	Representatives. 17
51	51	‘‘(2) B
52	52	ULK DATA.—The term ‘bulk data’ means 18
53	53	large quantities of data acquired without the use of 19
54	54	discriminants, a significant portion of which are not 20
55	55	reasonably likely to have intelligence or operational 21
56	56	value. 22
57	57	‘‘(3) D
58	58	ISCRIMINANTS.—The term 23
59	59	‘discriminants’ means identifiers and selection terms. 24
60	60	‘‘(b) A
61	61	NNUALAUDITS.—Not later than 180 days 25
62	62	after the date of the enactment of this section and annu-26

66	66	ally thereafter, the Under Secretary for Intelligence and 1
67	67	Analysis of the Department shall conduct an audit of the 2
68	68	information systems and bulk data of the Office of Intel-3
69	69	ligence and Analysis, which shall be consistent with the 4
70	70	intelligence oversight guidelines of the Office. 5
71	71	‘‘(c) N
72	72	OTIFICATIONS.—The Under Secretary for In-6
73	73	telligence and Analysis of the Department shall provide 7
74	74	the appropriate congressional committees with— 8
75	75	‘‘(1) a notification not later than 30 days after 9
76	76	the first analysis or other intelligence use by the Of-10
77	77	fice of Intelligence and Analysis after the date of the 11
78	78	enactment of this section of any new bulk data set 12
79	79	and the associated terms and conditions; and 13
80	80	‘‘(2) an update not later than 30 days after any 14
81	81	changes to such associated terms and conditions re-15
82	82	lated to the use of such a bulk data set. 16
83	83	‘‘(d) R
84	84	EPORTS ANDREVIEW.— 17
85	85	‘‘(1) R
86	86	EPORTS TO CONGRESS .—Not later than 18
87	87	30 days after the conclusion of each audit under 19
88	88	subsection (b), the Under Secretary for Intelligence 20
89	89	and Analysis of the Department shall submit to the 21
90	90	appropriate congressional committees the findings 22
91	91	and results of such audit. 23
92	92	‘‘(2) GAO
93	93	REVIEW.—Not later than four years 24
94	94	after the date of the enactment of this section, the 25

99	99	vide the appropriate congressional committees a re-2
100	100	view of the implementation of the annual audit re-3
101	101	quirement under subsection (b), challenges to the 4
102	102	implementation of such requirement, and rec-5
103	103	ommendations for improving such audits.’’. 6

105	105	LERICALAMENDMENT.—The table of contents 7
106	106	in section 1(b) of the Homeland Security Act of 2002 8
107	107	(Public Law 107–296; 116 Stat. 2135) is amended by in-9
108	108	serting after the item relating to section 210G the fol-10
109	109	lowing: 11
110	110	‘‘Sec. 210H. Annual audit of information systems and bulk data.’’.
