ANNUAL AUDIT OF DHS OFFICE OF INTELLIGENCE 1 AND ANALYSIS INFORMATION SYSTEMS AND 2 BULK DATA. 3 (a) I NGENERAL.—Subtitle A of title II of the Home-4 land Security Act of 2002 (6 U.S.C. 121 et seq.) is amend-5 ed by adding at the end the following: 6 ‘‘SEC. 210H. ANNUAL AUDIT OF INFORMATION SYSTEMS 7 AND BULK DATA. 8 ‘‘(a) D EFINITIONS.—In this section: 9 ‘‘(1) A PPROPRIATE CONGRESSIONAL COMMIT -10 TEES.—The term ‘appropriate congressional com-11 mittees’ means the Committee on Homeland Secu-12 rity and Governmental Affairs and the Select Com-13 mittee on Intelligence of the Senate and the Com-14 mittee on Homeland Security and the Permanent 15 Select Committee on Intelligence of the House of 16 Representatives. 17 ‘‘(2) B ULK DATA.—The term ‘bulk data’ means 18 large quantities of data acquired without the use of 19 discriminants, a significant portion of which are not 20 reasonably likely to have intelligence or operational 21 value. 22 ‘‘(3) D ISCRIMINANTS.—The term 23 ‘discriminants’ means identifiers and selection terms. 24 ‘‘(b) A NNUALAUDITS.—Not later than 180 days 25 after the date of the enactment of this section and annu-26 VerDate Sep 11 2014 22:09 Mar 15, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H1711.IH H1711 ssavage on LAPJG3WLY3PROD with BILLS 3 •HR 1711 IH ally thereafter, the Under Secretary for Intelligence and 1 Analysis of the Department shall conduct an audit of the 2 information systems and bulk data of the Office of Intel-3 ligence and Analysis, which shall be consistent with the 4 intelligence oversight guidelines of the Office. 5 ‘‘(c) N OTIFICATIONS.—The Under Secretary for In-6 telligence and Analysis of the Department shall provide 7 the appropriate congressional committees with— 8 ‘‘(1) a notification not later than 30 days after 9 the first analysis or other intelligence use by the Of-10 fice of Intelligence and Analysis after the date of the 11 enactment of this section of any new bulk data set 12 and the associated terms and conditions; and 13 ‘‘(2) an update not later than 30 days after any 14 changes to such associated terms and conditions re-15 lated to the use of such a bulk data set. 16 ‘‘(d) R EPORTS ANDREVIEW.— 17 ‘‘(1) R EPORTS TO CONGRESS .—Not later than 18 30 days after the conclusion of each audit under 19 subsection (b), the Under Secretary for Intelligence 20 and Analysis of the Department shall submit to the 21 appropriate congressional committees the findings 22 and results of such audit. 23 ‘‘(2) GAO REVIEW.—Not later than four years 24 after the date of the enactment of this section, the 25 VerDate Sep 11 2014 22:09 Mar 15, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H1711.IH H1711 ssavage on LAPJG3WLY3PROD with BILLS 4 •HR 1711 IH Comptroller General of the United States shall pro-1 vide the appropriate congressional committees a re-2 view of the implementation of the annual audit re-3 quirement under subsection (b), challenges to the 4 implementation of such requirement, and rec-5 ommendations for improving such audits.’’. 6 (b) C LERICALAMENDMENT.—The table of contents 7 in section 1(b) of the Homeland Security Act of 2002 8 (Public Law 107–296; 116 Stat. 2135) is amended by in-9 serting after the item relating to section 210G the fol-10 lowing: 11 ‘‘Sec. 210H. Annual audit of information systems and bulk data.’’.
