To amend the Consumer Product Safety Act to ensure 
amusement rides permanently fixed to a site are treated 
as consumer products, and for other purposes. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘National Amusement 4
Park Ride Safety Act’’. 5
SEC. 2. AMUSEMENT RIDES PERMANENTLY FIXED TO A 6
SITE. 7
(a) I
NGENERAL.—Section 3(a)(5) of the Consumer 8
Product Safety Act (15 U.S.C. 2052(a)(5)) is amended 9

by striking ‘‘, and which is not permanently fixed to a 1
site. Such term does not include such a device which is 2
permanently fixed to a site.’’ and inserting a period. 3
(b) A
UTHORIZATION OFAPPROPRIATIONS.— 4
(1) I
N GENERAL.—In addition to amounts oth-5
erwise authorized to be appropriated to the Con-6
sumer Product Safety Commission, there is author-7
ized to be appropriated to the Commission each fis-8
cal year for activities relating to covered devices 9
$11,500,000, of which— 10
(A) $5,000,000 each fiscal year is author-11
ized to be appropriated exclusively for activities 12
relating to covered devices not permanently 13
fixed to a site; and 14
(B) $6,500,000 each fiscal year is author-15
ized to be appropriated exclusively for activities 16
relating to covered devices permanently fixed to 17
a site. 18
(2) C
OVERED DEVICE DEFINED .—In this sub-19
section, the term ‘‘covered device’’ means a mechan-20
ical device which carries or conveys passengers 21
along, around, or over a fixed or restricted route or 22
course or within a defined area for the purpose of 23
giving its passengers amusement, which is custom-24
arily controlled or directed by an individual who is 25

employed for that purpose and who is not a con-1
sumer with respect to such device. 2
