3434 acted, would result in the reduction of any existing benefit 8
3535 provided or administered by the Social Security Adminis-9
3636 tration or the Centers for Medicare and Medicaid Services 10
3737 may not be considered in the House of Representatives 11
3838 or the Senate unless two-thirds of the Members present 12
3939 and voting agree to a motion to consider the bill, joint 13
4040 resolution, or amendment with the provision included. 14

4242 XCEPTION FORPAYMENTS TOMEDICAREAD-15
4343 VANTAGEPLANS.—Subsection (a) does not apply to any 16
4444 provision which, if enacted, would result in the reduction 17
4545 of any payment made to a Medicare Advantage plan under 18
4646 part C of title XVIII of the Social Security Act (42 U.S.C. 19
4747 1395w–21 et seq.), but only if the provision would, if en-20
4848 acted, result in an increase in the amount of payments 21
4949 made for other purposes under title XVIII of the Social 22
5050 Security Act in an amount equal to or greater than the 23
5151 amount of the reduction in payment made to the Medicare 24
5252 Advantage plan. 25

5656 SEC. 3. DETERMINATION OF REDUCTION OF BENEFITS. 1
5757 During the consideration of a bill, joint resolution, 2
5858 or amendment in the House of Representatives or Senate, 3
5959 any determination regarding whether a provision in the 4
6060 bill, joint resolution, or amendment would, if enacted, re-5
6161 sult in a reduction described in section 2(a) or a reduction 6
6262 or increase described in section 2(b) shall be made solely 7
6363 on the basis of a determination made by the Office of the 8
6464 Chief Actuary of the Social Security Administration. 9
