A BILL 
To protect benefits provided under Social Security, Medicare, 
and any other program of benefits administered by the 
Social Security Administration or the Centers for Medi-
care and Medicaid Services. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Protect Social Security 4
and Medicare Act’’. 5

SEC. 2. SUPERMAJORITY VOTE REQUIRED TO CUT BENE-1
FITS ADMINISTERED BY SOCIAL SECURITY 2
ADMINISTRATION OR CENTERS FOR MEDI-3
CARE AND MEDICAID SERVICES. 4
(a) S
UPERMAJORITYVOTEREQUIREMENT.—A bill or 5
joint resolution, or any amendment offered to a bill or 6
joint resolution, which contains any provision which, if en-7
acted, would result in the reduction of any existing benefit 8
provided or administered by the Social Security Adminis-9
tration or the Centers for Medicare and Medicaid Services 10
may not be considered in the House of Representatives 11
or the Senate unless two-thirds of the Members present 12
and voting agree to a motion to consider the bill, joint 13
resolution, or amendment with the provision included. 14
(b) E
XCEPTION FORPAYMENTS TOMEDICAREAD-15
VANTAGEPLANS.—Subsection (a) does not apply to any 16
provision which, if enacted, would result in the reduction 17
of any payment made to a Medicare Advantage plan under 18
part C of title XVIII of the Social Security Act (42 U.S.C. 19
1395w–21 et seq.), but only if the provision would, if en-20
acted, result in an increase in the amount of payments 21
made for other purposes under title XVIII of the Social 22
Security Act in an amount equal to or greater than the 23
amount of the reduction in payment made to the Medicare 24
Advantage plan. 25

SEC. 3. DETERMINATION OF REDUCTION OF BENEFITS. 1
During the consideration of a bill, joint resolution, 2
or amendment in the House of Representatives or Senate, 3
any determination regarding whether a provision in the 4
bill, joint resolution, or amendment would, if enacted, re-5
sult in a reduction described in section 2(a) or a reduction 6
or increase described in section 2(b) shall be made solely 7
on the basis of a determination made by the Office of the 8
Chief Actuary of the Social Security Administration. 9
