3030 NGENERAL.—Chapter 27 of title 14, United 3
3131 States Code, is amended by adding at the end the fol-4
3232 lowing: 5
3333 ‘‘§ 2780. Pay; continuation during lapse in appropria-6
3434 tions 7
3535 ‘‘(a) I
3636 NGENERAL.—In the case of any period in 8
3737 which there is a Coast Guard-specific funding lapse, there 9
3838 are appropriated such sums as may be necessary— 10
3939 ‘‘(1) to provide pay and allowances to military 11
4040 members of the Coast Guard, including the reserve 12
4141 component thereof, who perform active service or in-13
4242 active-duty training during such period; 14
4343 ‘‘(2) to provide pay and benefits to qualified ci-15
4444 vilian employees of the Coast Guard; and 16
4545 ‘‘(3) to provide pay and benefits to qualified 17
4646 contract employees of the Coast Guard. 18
4747 ‘‘(b) A
4848 PPLICATION OFANTI-DEFICIENCYACT.—Sec-19
4949 tion 1341 of title 31 (commonly referred to as the ‘Anti- 20
5050 Deficiency Act’) shall apply to operations carried out 21
5151 under this section, except— 22
5252 ‘‘(1) in the case of law that expressly authorizes 23
5353 incurring obligations in advance of appropriations; 24

5757 ‘‘(2) operations that involve emergencies involv-1
5858 ing the safety of human life or the protection of 2
5959 property; and 3
6060 ‘‘(3) with respect to functions necessary to dis-4
6161 charge the congressional duties of the President. 5

6363 OASTGUARD-SPECIFICFUNDINGLAPSE.—For 6
6464 purposes of this section, a Coast Guard-specific funding 7
6565 lapse occurs in any case in which a general appropriation 8
6666 bill providing appropriations for the Coast Guard for a 9
6767 fiscal year is not enacted before the beginning of such fis-10
6868 cal year (and no joint resolution making continuing appro-11
6969 priations for the Coast Guard is in effect). 12
7070 ‘‘(d) T
7171 ERMINATION.—Appropriations and funds 13
7272 made available and authority granted for any fiscal year 14
7373 for any purpose under subsection (a) shall be available 15
7474 until whichever of the following first occurs: 16
7575 ‘‘(1) The enactment into law of an appropria-17
7676 tion (including a continuing appropriation) for such 18
7777 purpose. 19
7878 ‘‘(2) The enactment into law of the applicable 20
7979 regular or continuing appropriations resolution or 21
8080 other Act without any appropriation for such pur-22
8181 pose. 23

8383 EFINITIONS.—In this section: 24

8787 ‘‘(1) QUALIFIED CIVILIAN EMPLOYEE .—The 1
8888 term ‘qualified civilian employee’ means a civilian 2
8989 employee of the Coast Guard who the Commandant 3
9090 determines is— 4
9191 ‘‘(A) providing support to members of the 5
9292 Coast Guard or another Armed Force; or 6
9393 ‘‘(B) performing work as an excepted em-7
9494 ployee or an employee performing emergency 8
9595 work, as such terms are defined by the Office 9
9696 of Personnel Management. 10
9797 ‘‘(2) Q
9898 UALIFIED CONTRACT EMPLOYEE OF THE 11
9999 COAST GUARD.—The term ‘qualified contract em-12
100100 ployee of the Coast Guard’ means an individual per-13
101101 forming work under a contract who the Com-14
102102 mandant determines is— 15
103103 ‘‘(A) providing support to military mem-16
104104 bers or qualified civilian employees of the Coast 17
105105 Guard or another Armed Force; or 18
106106 ‘‘(B) required to perform work during a 19
107107 lapse in appropriations.’’. 20

110110 ter 27 of title 14, United States Code, is amended by add-22
111111 ing at the end the following: 23
