PAY; CONTINUATION DURING LAPSE IN APPROPRIA-1 TIONS. 2 (a) I NGENERAL.—Chapter 27 of title 14, United 3 States Code, is amended by adding at the end the fol-4 lowing: 5 ‘‘§ 2780. Pay; continuation during lapse in appropria-6 tions 7 ‘‘(a) I NGENERAL.—In the case of any period in 8 which there is a Coast Guard-specific funding lapse, there 9 are appropriated such sums as may be necessary— 10 ‘‘(1) to provide pay and allowances to military 11 members of the Coast Guard, including the reserve 12 component thereof, who perform active service or in-13 active-duty training during such period; 14 ‘‘(2) to provide pay and benefits to qualified ci-15 vilian employees of the Coast Guard; and 16 ‘‘(3) to provide pay and benefits to qualified 17 contract employees of the Coast Guard. 18 ‘‘(b) A PPLICATION OFANTI-DEFICIENCYACT.—Sec-19 tion 1341 of title 31 (commonly referred to as the ‘Anti- 20 Deficiency Act’) shall apply to operations carried out 21 under this section, except— 22 ‘‘(1) in the case of law that expressly authorizes 23 incurring obligations in advance of appropriations; 24 VerDate Sep 11 2014 22:54 Mar 24, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2051.IH H2051 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •HR 2051 IH ‘‘(2) operations that involve emergencies involv-1 ing the safety of human life or the protection of 2 property; and 3 ‘‘(3) with respect to functions necessary to dis-4 charge the congressional duties of the President. 5 ‘‘(c) C OASTGUARD-SPECIFICFUNDINGLAPSE.—For 6 purposes of this section, a Coast Guard-specific funding 7 lapse occurs in any case in which a general appropriation 8 bill providing appropriations for the Coast Guard for a 9 fiscal year is not enacted before the beginning of such fis-10 cal year (and no joint resolution making continuing appro-11 priations for the Coast Guard is in effect). 12 ‘‘(d) T ERMINATION.—Appropriations and funds 13 made available and authority granted for any fiscal year 14 for any purpose under subsection (a) shall be available 15 until whichever of the following first occurs: 16 ‘‘(1) The enactment into law of an appropria-17 tion (including a continuing appropriation) for such 18 purpose. 19 ‘‘(2) The enactment into law of the applicable 20 regular or continuing appropriations resolution or 21 other Act without any appropriation for such pur-22 pose. 23 ‘‘(e) D EFINITIONS.—In this section: 24 VerDate Sep 11 2014 22:54 Mar 24, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2051.IH H2051 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •HR 2051 IH ‘‘(1) QUALIFIED CIVILIAN EMPLOYEE .—The 1 term ‘qualified civilian employee’ means a civilian 2 employee of the Coast Guard who the Commandant 3 determines is— 4 ‘‘(A) providing support to members of the 5 Coast Guard or another Armed Force; or 6 ‘‘(B) performing work as an excepted em-7 ployee or an employee performing emergency 8 work, as such terms are defined by the Office 9 of Personnel Management. 10 ‘‘(2) Q UALIFIED CONTRACT EMPLOYEE OF THE 11 COAST GUARD.—The term ‘qualified contract em-12 ployee of the Coast Guard’ means an individual per-13 forming work under a contract who the Com-14 mandant determines is— 15 ‘‘(A) providing support to military mem-16 bers or qualified civilian employees of the Coast 17 Guard or another Armed Force; or 18 ‘‘(B) required to perform work during a 19 lapse in appropriations.’’. 20 (b) C LERICALAMENDMENT.—The analysis for chap-21 ter 27 of title 14, United States Code, is amended by add-22 ing at the end the following: 23 ‘‘2780.
