237237 (A) a licensed gaming facility that offers 13
238238 sports wagering; and 14

243243 term ‘‘sports wagering opt-in State’’ means a State 18

255255 ‘‘State regulatory entity’’ means the governmental 2

257257 (A) established or designated by a sports 4
258258 wagering opt-in State under section 5
259259 102(a)(2)(A)(ii); and 6
260260 (B) responsible, solely or in coordination 7
261261 with 1 or more other governmental entities, for 8
262262 the regulation of sports wagering in the applica-9
263263 ble sports wagering opt-in State. 10

265265 TATE SOCIAL GAMBLING LAW .—The term 11
266266 ‘‘State social gambling law’’ means a State law that 12
267267 allows sports wagering that— 13
268268 (A) is not conducted as a business; 14
269269 (B) involves 2 or more players who com-15
270270 pete on equal terms; and 16
271271 (C) does not provide a benefit to— 17
272272 (i) a player, other than the winnings 18
273273 of the player; or 19
274274 (ii) a person who is not involved in a 20

293293 late or evade, any Federal, State, or local law 10
294294 (including regulations); or 11
295295 (B) sports wagering by or on behalf of an 12
296296 individual described in subparagraph (C), (D), 13
297297 or (E) of section 103(b)(4). 14

299299 USPICIOUS TRANSACTION REPORT .—The 15
300300 term ‘‘suspicious transaction report’’ means a report 16
301301 submitted to a State regulatory entity or a sports 17
302302 organization under section 103(b)(13). 18

304304 RIBAL-STATE COMPACT .—The term 19
305305 ‘‘Tribal-State compact’’ means a compact entered 20
306306 into between a State and an Indian Tribe pursuant 21

318318 (b), it shall be unlawful for any person to knowingly accept 6
319319 a sports wager. 7

323323 (1) a sports wagering operator located in a 10
324324 sports wagering opt-in State to accept a sports 11
325325 wager in accordance with State law; or 12

327327 ance with an applicable State social gambling law. 14

331331 N GENERAL.—If the Attorney General be-16
332332 lieves a person has violated, is violating, or will vio-17
333333 late subsection (a), the Attorney General may bring 18
334334 a civil action in the appropriate district court of the 19
335335 United States or the appropriate United States 20
336336 court of a territory or possession of the United 21
337337 States, which shall have jurisdiction in proceedings 22
338338 in accordance with the Federal Rules of Civil Proce-23
339339 dure to enjoin a violation of subsection (a). 24

344344 lation of an injunction or restraining order issued 2

346346 the accused, by a jury in accordance with the Fed-4
347347 eral Rules of Civil Procedure. 5

352352 subsection (a) shall be, with respect to any such vio-8
353353 lation, subject to a civil penalty of not more than the 9
354354 greater of $10,000 or 3 times the amount of the ap-10
355355 plicable sports wager. 11

357357 EPARATE VIOLATIONS.—A separate viola-12
358358 tion occurs for each sports wager accepted in viola-13
359359 tion of subsection (a). 14

361361 URISDICTION.—The district courts of the 15
362362 United States and appropriate United States courts 16
363363 of the territories and possessions of the United 17
364364 States shall have jurisdiction to enforce this sub-18
365365 section in accordance with section 1355 of title 28, 19
366366 United States Code. 20

368368 FFECT OF LAW.—A violation of subsection 21
369369 (a) shall not constitute a crime, and a judgment for 22
370370 the United States and imposition of a civil penalty 23
371371 pursuant to paragraph (1) shall not give rise to any 24

380380 ENALTY.—A civil penalty, injunction, or temporary re-4
381381 straining order imposed under this section shall be inde-5
382382 pendent of, and not in lieu of, criminal prosecutions or 6
383383 any other proceedings under any other law of the United 7
384384 States, including sections 1084 and 1955 of title 18, 8
385385 United States Code. 9

387387 FFECTIVEDATE.—Subsection (a) shall take ef-10
388388 fect on the date that is 18 months after the date of enact-11
389389 ment of this Act. 12
390390 SEC. 102. STATE SPORTS WAGERING PROGRAM. 13

392392 NITIALAPPLICATION.— 14

394394 N GENERAL.—To request approval to ad-15
395395 minister a State sports wagering program, a State 16
396396 shall submit an application to the Attorney General 17
397397 at such time, in such manner, and accompanied by 18
398398 such information as the Attorney General may re-19
399399 quire. 20
400400 (2) C
401401 ONTENTS.—An application under para-21
402402 graph (1) shall include— 22
403403 (A) a full and complete description of the 23
404404 State sports wagering program the State pro-24

410410 (i) each applicable State law relating 3
411411 to sports wagering; and 4
412412 (ii) an identification of the State regu-5
413413 latory entity; and 6
414414 (B) an assurance from the attorney gen-7
415415 eral or chief legal officer of the State that the 8
416416 laws of the State provide adequate authority to 9
417417 carry out the proposed State sports wagering 10
418418 program. 11
419419 (b) A
420420 PPROVAL BYATTORNEYGENERAL.— 12
421421 (1) I
422422 N GENERAL.—Not later than 180 days 13
423423 after the date on which the Attorney General re-14
424424 ceives a complete application under this section, the 15
425425 Attorney General shall approve the application un-16
426426 less the Attorney General determines that the pro-17
427427 posed State sports wagering program does not meet 18
428428 the standards set forth in section 103. 19

430430 ENIAL OF APPLICATION .—A decision of 20
431431 the Attorney General to deny an application sub-21
432432 mitted under this section shall— 22
433433 (A) be made in writing; and 23

441441 OTICE OFMATERIALCHANGES.—In the case of 4
442442 a material change to a State law relating to sports wager-5
443443 ing, the State regulatory entity, or other information in-6
444444 cluded in an application submitted pursuant to subsection 7
445445 (a) or (e), not later than 30 days after the date on which 8
446446 the change is made, the State shall submit to the Attorney 9
447447 General a notice of such change. 10

449449 URATION.—A State sports wagering program 11
450450 shall be valid for a fixed 3-year period beginning on the 12
451451 date on which the Attorney General approves the applica-13
452452 tion of the applicable State under subsection (a) or (e). 14

454454 ENEWALAPPLICATION AND APPROVAL.—Not 15
455455 later than the date on which the 3-year period referred 16
456456 to in subsection (d) ends, a State seeking to renew the 17
457457 approval of the State sports wagering program may sub-18
458458 mit to the Attorney General a renewal application that— 19
459459 (1) includes the information described in sub-20
460460 section (a); and 21
461461 (2) shall be subject to the approval process 22
462462 under subsection (b). 23

464464 EVOCATION ANDREVIEW.— 24

469469 The Attorney General shall promulgate regulations 2
470470 that provide procedures by which the Attorney Gen-3
471471 eral may revoke the approval of a State to admin-4
472472 ister a State sports wagering program before the 5
473473 date on which the 3-year term described in sub-6
474474 section (d) expires if the Attorney General finds that 7
475475 the sports wagering program does not meet 1 or 8
476476 more standards set forth in section 103. 9

478478 DMINISTRATIVE REVIEW .—The Attorney 10
479479 General shall promulgate regulations that provide 11
480480 procedures by which a State may seek administra-12
481481 tive review of any decision by the Attorney Gen-13
482482 eral— 14
483483 (A) to deny an application under sub-15
484484 section (b); 16
485485 (B) to deny a renewal application under 17
486486 subsection (e); or 18

15601560 that is in addition to, or more stringent than, the require-9

15631563 AXATION OFSPORTSWAGERING.—Nothing in 11
15641564 this Act limits or otherwise affects the taxation of sports 12
