SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Major Richard Star 4
Act’’. 5

BAT-RELATED DISABILITIES FOR CONCUR-2
RENT RECEIPT OF VETERANS’ DISABILITY 3
COMPENSATION AND RETIRED PAY. 4
(a) C
ONCURRENTRECEIPT INCONNECTIONWITH 5
CRSC.—Section 1413a(b)(3) of title 10, United States 6
Code, is amended— 7
(1) in subparagraph (A)— 8
(A) by striking ‘‘of this title, the amount’’ 9
and inserting ‘‘of this title— 10
‘‘(i) the retired pay of the retiree is 11
not subject to reduction under sections 12
5304 and 5305 of title 38; and 13
‘‘(ii) the amount’’; and 14
(B) by striking ‘‘after any such reduction 15
under sections 5304 and 5305 of title 38’’; and 16
(2) in subparagraph (B)— 17
(A) by striking ‘‘creditable service, the 18
amount’’ and inserting the following: ‘‘cred-19
itable service— 20
‘‘(i) the retired pay of the retiree is 21
not subject to reduction under sections 22
5304 and 5305 of title 38; and 23
‘‘(ii) the amount’’; and 24
(B) by striking ‘‘after any such reduction 25
under sections 5304 and 5305 of title 38’’. 26

(b) CONCURRENT RECEIPTGENERALLY.—Section 1
1414(b) of title 10, United States Code, is amended to 2
read as follows: 3
‘‘(b) S
PECIALRULE FORCHAPTER61 DISABILITY 4
R
ETIREES.—A member or former member of the uni-5
formed services who is entitled to retired pay under chap-6
ter 61 of this title for any month and who is also entitled 7
for that month to veterans’ disability compensation for a 8
combat-related disability (as that term is defined in sec-9
tion 1413a(e) of this title) is entitled to be paid both for 10
that month without regard to sections 5304 and 5305 of 11
title 38.’’. 12
(c) T
ECHNICAL ANDCONFORMINGAMENDMENTS.— 13
(1) A
MENDMENTS REFLECTING END OF CON -14
CURRENT RECEIPT PHASE -IN PERIOD.—Section 15
1414 of title 10, United States Code, is further 16
amended— 17
(A) in subsection (a)(1)— 18
(i) by striking the second sentence; 19
and 20
(ii) by striking subparagraphs (A) and 21
(B); 22
(B) by striking subsection (c) and redesig-23
nating subsections (d) and (e) as subsections 24
(c) and (d), respectively; and 25

(C) in subsection (d), as redesignated, by 1
striking paragraphs (3) and (4). 2

ECTION HEADING.—The heading of such 3
section 1414 is amended to read as follows: 4
‘‘§ 1414. Members eligible for retired pay who are also 5
eligible for veterans’ disability compensa-6
tion: concurrent receipt.’’. 7
(3) T
ABLE OF SECTIONS.—The table of sections 8
at the beginning of chapter 71 of such title is 9
amended by striking the item relating to section 10
1414 and inserting the following new item: 11
‘‘1414. Members eligible for retired pay who are also eligible for veterans’ dis-
ability compensation: concurrent receipt.’’.
(4) CONFORMING AMENDMENT .—Section 12
1413a(f) of such title is amended by striking ‘‘Sub-13
section (d)’’ and inserting ‘‘Subsection (c)’’. 14
(d) E
FFECTIVEDATE.—The amendments made by 15
this section shall take effect on the first day of the first 16
month beginning after the date of the enactment of this 17
Act and shall apply to payments for months beginning on 18
or after that date. 19
