3333 NAPPLICABILITY OFCURRENTRULE.—Effective 4
3434 beginning on the date of the enactment of this Act, section 5
3535 118.4(e) of title 21, Code of Federal Regulations (or suc-6
3636 cessor regulations) shall not apply with respect to surplus 7
3737 broiler hatching eggs that are intended to be sold to an 8
3838 egg breaker for purposes of processing such eggs as liquid 9
3939 egg products subject to regulation under the Egg Products 10
4040 Inspection Act (21 U.S.C. 1031 et seq.). 11

4242 EVISEDRULEREQUIRED.—Not later than 180 12
4343 days after the date of the enactment of this Act, the Sec-13
4444 retary of Health and Human Services, acting through the 14
4545 Commissioner of Food and Drugs, and in consultation 15
4646 with the Secretary of Agriculture, shall issue a rule revis-16
4747 ing section 118.4 of title 21, Code of Federal Regulations 17
4848 (or successor regulations), to allow for surplus broiler 18
4949 hatching eggs to be held at such temperature and for such 19
5050 period of time at such temperature, so as to be compatible 20
5151 with conditions for hatching chicks and to allow for the 21
5252 sale of such eggs to egg breakers for the purposes de-22
5353 scribed in subsection (a). 23

5959 (1) The terms ‘‘egg’’ and ‘‘egg product’’ have 1
6060 the meanings given such terms in section 4 of the 2
6161 Egg Products Inspection Act (21 U.S.C. 1033). 3
6262 (2) The term ‘‘egg breaker’’ means a facility in 4
6363 the commercial sector that processes eggs by break-5
6464 ing the eggs out of their shells and selling the result-6
6565 ing liquid egg product in bulk to food manufactur-7
6666 ers. 8
6767 (3) The term ‘‘broiler hatching egg’’ means an 9
6868 egg intended for use by broiler hatcheries for the 10
6969 production of baby chicks. 11
7070 (4) The term ‘‘broiler hatchery’’ means a facil-12
7171 ity where fertilized eggs from broiler breeder chick-13
7272 ens are incubated and hatched into day-old chicks, 14
7373 which are then raised on farms to produce meat as 15
7474 broiler chickens. 16
