INAPPLICABILITY OF CERTAIN SHELL EGG RULE 1 PROVISIONS TO SURPLUS BROILER HATCH-2 ING EGGS SOLD TO EGG BREAKERS. 3 (a) I NAPPLICABILITY OFCURRENTRULE.—Effective 4 beginning on the date of the enactment of this Act, section 5 118.4(e) of title 21, Code of Federal Regulations (or suc-6 cessor regulations) shall not apply with respect to surplus 7 broiler hatching eggs that are intended to be sold to an 8 egg breaker for purposes of processing such eggs as liquid 9 egg products subject to regulation under the Egg Products 10 Inspection Act (21 U.S.C. 1031 et seq.). 11 (b) R EVISEDRULEREQUIRED.—Not later than 180 12 days after the date of the enactment of this Act, the Sec-13 retary of Health and Human Services, acting through the 14 Commissioner of Food and Drugs, and in consultation 15 with the Secretary of Agriculture, shall issue a rule revis-16 ing section 118.4 of title 21, Code of Federal Regulations 17 (or successor regulations), to allow for surplus broiler 18 hatching eggs to be held at such temperature and for such 19 period of time at such temperature, so as to be compatible 20 with conditions for hatching chicks and to allow for the 21 sale of such eggs to egg breakers for the purposes de-22 scribed in subsection (a). 23 (c) D EFINITIONS.—In this Act: 24 VerDate Sep 11 2014 22:03 Mar 28, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2222.IH H2222 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •HR 2222 IH (1) The terms ‘‘egg’’ and ‘‘egg product’’ have 1 the meanings given such terms in section 4 of the 2 Egg Products Inspection Act (21 U.S.C. 1033). 3 (2) The term ‘‘egg breaker’’ means a facility in 4 the commercial sector that processes eggs by break-5 ing the eggs out of their shells and selling the result-6 ing liquid egg product in bulk to food manufactur-7 ers. 8 (3) The term ‘‘broiler hatching egg’’ means an 9 egg intended for use by broiler hatcheries for the 10 production of baby chicks. 11 (4) The term ‘‘broiler hatchery’’ means a facil-12 ity where fertilized eggs from broiler breeder chick-13 ens are incubated and hatched into day-old chicks, 14 which are then raised on farms to produce meat as 15 broiler chickens. 16 Æ VerDate Sep 11 2014 22:03 Mar 28, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H2222.IH H2222 kjohnson on DSK7ZCZBW3PROD with $$_JOB
