8383 contracts to purchase agricultural commodities 18
8484 under the food distribution program for the Indian 19
8585 reservation of that Tribal entity. 20

8787 LIGIBILITY.— 21

8989 ONSULTATION.—The Secretary shall 22
9090 consult with Tribal entities to determine the 23
9191 process under which each entity may participate 24
9292 in the demonstration project. 25

9696 (B) CRITERIA.—The Secretary shall select 1
9797 for participation in the demonstration project 2
9898 Tribal entities that— 3
9999 (i) are successfully administering the 4
100100 food distribution program of the Tribal en-5
101101 tity; 6
102102 (ii) have the capacity to purchase ag-7
103103 ricultural commodities in accordance with 8
104104 paragraph (4) for the food distribution 9
105105 program of the Tribal entity; and 10
106106 (iii) meet any other criteria deter-11
107107 mined by the Secretary, in consultation 12
108108 with the Secretary of the Interior and 13
109109 Tribal entities. 14

111111 ROCUREMENT OF AGRICULTURAL COM -15
112112 MODITIES.—Any agricultural commodities purchased 16
113113 by a Tribal entity under the demonstration project 17
114114 shall— 18
115115 (A) be domestically produced; 19
116116 (B) not result in a material increase in the 20
117117 amount of food in the food package of that 21
118118 Tribal entity compared to the amount of food 22
119119 that the Secretary authorized to be provided 23
120120 through the CSFP Guide Rate; 24

127127 package for that Tribal entity or be an agricul-4
128128 tural commodity with Tribal significance to that 5

130130 (D) meet any other criteria determined by 7
131131 the Secretary. 8

133133 EPORT.—Not later than 1 year after the 9
134134 date on which funds are appropriated under para-10
135135 graph (6), and annually thereafter, the Secretary 11
136136 shall submit to the Committee on Agriculture of the 12
137137 House of Representatives and the Committee on Ag-13
138138 riculture, Nutrition, and Forestry of the Senate a 14
139139 report describing the activities carried out under the 15
140140 demonstration project during the preceding year. 16

145145 TIONS.—There is authorized to be appropriated 19
146146 to the Secretary to carry out this subsection 20

165165 (A) awarding of FNS nutrition program 9
166166 self-determination contracts to selected Tribal 10
167167 entities; and 11
168168 (B) hiring contract officers and program 12
169169 staff in order to manage the selection of Tribal 13
170170 entities and execution of self-determination con-14
171171 tracts. 15

173173 TAFFING MINIMUM FUNDING .—Notwith-16
174174 standing any other provision of law, there is author-17
175175 ized to be appropriated to the Secretary $1,200,000 18
176176 for each of fiscal years 2026 through 2029 for the 19
177177 payment of Department contract officers and pro-20
178178 gram staff salaries and benefits. 21
