Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Preserving Presidential 4
Management Authority Act’’. 5

SEC. 2. DISCRETION TO NEGOTIATE COLLECTIVE BAR-1
GAINING AGREEMENTS BY PRESIDENT AND 2
CLARIFYING EFFECT OF CONFLICTING PRES-3
IDENTIAL ACTIONS. 4
(a) I
NGENERAL.—Subchapter I of chapter 71 of title 5
5, United States Code, is amended by adding at the end 6
the following: 7
‘‘§ 7107. Presidential authority to negotiate collective 8
bargaining agreements; clarification of 9
effect of conflicting presidential actions 10
‘‘(a) A
UTHORITY OF PRESIDENTTONEGOTIATE 11
A
GREEMENTS.—The President may, acting through the 12
head of an agency, terminate any provision of a collective 13
bargaining agreement entered into under this chapter that 14
is in force and effect on the date such President swears 15
or affirms the oath of office as President. 16
‘‘(b) C
LARIFYINGEFFECT OFCONFLICTINGPRESI-17
DENTIALACTIONS.—A provision of any collective bar-18
gaining agreement that conflicts with a rule, executive 19
order, presidential memorandum, or any other presidential 20
order, as determined by the President or the head of an 21
agency, shall not be enforceable. 22
‘‘(c) L
IMITATION.—The authority under subsection 23
(a) may not be exercised by an incumbent President. 24

OTIFICATION.—On the date the President or-25
ders any termination under subsection (a) or a determina-26

tion is made under subsection (b), the head of the relevant 1
agency shall submit a notice (in writing) to the applicable 2
exclusive representative describing such termination or 3
conflicting provisions of such an agreement.’’. 4

LERICALAMENDMENT.—The table of sections 5
for such subchapter is amended by adding after the item 6
relating to section 7106 the following: 7
‘‘7107. Presidential authority to negotiate collective bargaining agreements; clar-
ification of effect of conflicting presidential actions.’’.
