2323 SECTION 101. SHORT TITLE. 3
2424 This Act may be cited as the ‘‘National Fallen Fire-4
2525 fighters Memorial Coin Act’’. 5

2929 SEC. 102. COIN SPECIFICATIONS. 1

3131 ENOMINATIONS.—The Secretary of the Treas-2
3232 ury (hereafter in this Act referred to as the ‘‘Secretary’’) 3
3333 shall mint and issue the following coin: 4
3434 (1) $5
3535 GOLD COINS.—Not more than 50,000 $5 5
3636 coins, which shall— 6
3737 (A) weigh 8.359 grams; 7
3838 (B) have a diameter of 0.850 inches; and 8
3939 (C) contain not less than 90 percent gold. 9
4040 (2) $1
4141 SILVER COINS.—Not more than 400,000 10
4242 $1 coins, which shall— 11
4343 (A) weigh 26.73 grams; 12
4444 (B) have a diameter of 1.500 inches; and 13
4545 (C) contain not less than 90 percent silver. 14

4747 ALF-DOLLAR CLAD COINS .—Not more 15
4848 than 750,000 half-dollar coins which shall— 16
4949 (A) weigh 11.34 grams; 17
5050 (B) have a diameter of 1.205 inches; and 18
5151 (C) be minted to the specifications for half- 19
5252 dollar coins contained in section 5112(b) of title 20
5353 31, United States Code. 21

5555 EGALTENDER.—The coins minted under this 22
5656 Act shall be legal tender, as provided in section 5103 of 23
5757 title 31, United States Code. 24

6363 under this Act shall be considered to be numismatic items. 3
6464 SEC. 103. DESIGN OF COINS. 4

6868 N GENERAL.—The design of the coins 6
6969 minted under this Act shall be emblematic of the 7
7070 National Fallen Firefighters Memorial and the serv-8
7171 ice and sacrifice of firefighters throughout the his-9
7272 tory of the United States. 10

7474 ESIGNATION AND INSCRIPTIONS .—On 11
7575 each coin minted under this Act there shall be— 12
7676 (A) a designation of the value of the coin; 13
7777 (B) an inscription of the year ‘‘2026’’; and 14
7878 (C) inscriptions of the words ‘‘Liberty’’, 15
7979 ‘‘In God We Trust’’, ‘‘United States of Amer-16
8080 ica’’, and ‘‘E Pluribus Unum’’. 17

8282 ELECTION.—The design for the coins minted 18
8383 under this Act shall be— 19
8484 (1) selected by the Secretary after consultation 20
8585 with the Commission of Fine Arts and the National 21
8686 Fallen Firefighters Foundation; and 22
8787 (2) reviewed by the Citizens Coinage Advisory 23
8888 Committee. 24

9292 SEC. 104. ISSUANCE OF COINS. 1
9393 (a) Q
9494 UALITY OFCOINS.—Coins minted under this 2
9595 Act shall be issued in uncirculated and proof qualities. 3
9696 (b) M
9797 INTFACILITIES.—Only 1 facility of the United 4
9898 States Mint may be used to strike any particular quality 5
9999 of the coins minted under this Act. 6

101101 ERIOD FORISSUANCE.—The Secretary may 7
102102 issue coins minted under this Act only during the 1-year 8
103103 period beginning on January 1, 2026. 9
104104 SEC. 105. SALE OF COINS. 10
105105 (a) S
106106 ALEPRICE.—The coins issued under this Act 11
107107 shall be sold by the Secretary at a price equal to the sum 12
108108 of— 13
109109 (1) the face value of the coins; 14
110110 (2) the surcharge provided in section 106(a) 15
111111 with respect to such coins; and 16
112112 (3) the cost of designing and issuing the coins 17
113113 (including labor, materials, dies, use of machinery, 18
114114 overhead expenses, marketing, and shipping). 19

116116 ULKSALES.—The Secretary shall make bulk 20
117117 sales of the coins issued under this Act at a reasonable 21
118118 discount. 22

120120 REPAIDORDERS.— 23

122122 N GENERAL.—The Secretary shall accept 24
123123 prepaid orders for the coins minted under this Act 25
124124 before the issuance of such coins. 26

128128 (2) DISCOUNT.—Sale prices with respect to pre-1
129129 paid orders under paragraph (1) shall be at a rea-2
130130 sonable discount. 3
131131 SEC. 106. SURCHARGES. 4
132132 (a) I
133133 NGENERAL.—All sales of coins issued under this 5
134134 Act shall include a surcharge of— 6
135135 (1) $35 per coin for the $5 coin; 7
136136 (2) $10 per coin for the $1 coin; and 8
137137 (3) $5 per coin for the half-dollar coin. 9

139139 ISTRIBUTION.—Subject to section 5134(f)(1) of 10
140140 title 31, United States Code, all surcharges received by 11
141141 the Secretary from the sale of coins issued under this Act 12
142142 shall be promptly paid by the Secretary to the National 13
143143 Fallen Firefighters Foundation to support the mission and 14
144144 programs of the Foundation. 15
145145 (c) A
146146 UDITS.—The National Fallen Firefighters 16
147147 Foundation shall be subject to the audit requirements of 17
148148 section 5134(f)(2) of title 31, United States Code, with 18
149149 regard to the amounts received under subsection (b). 19

151151 IMITATION.—Notwithstanding subsection (a), 20
152152 no surcharge may be included with respect to the issuance 21
153153 under this Act of any coin during a calendar year if, as 22
154154 of the time of such issuance, the issuance of such coin 23
155155 would result in the number of commemorative coin pro-24
156156 grams issued during such year to exceed the annual 2 25

161161 section 5112(m)(1) of title 31, United States Code (as in 2
162162 effect on the date of the enactment of this Act). The Sec-3
163163 retary of the Treasury may issue guidance to carry out 4
164164 this subsection. 5
165165 SEC. 107. FINANCIAL ASSURANCES. 6
166166 The Secretary shall take such actions as may be nec-7
167167 essary to ensure that— 8
168168 (1) minting and issuing coins under this Act 9
169169 will not result in any net cost to the United States 10
170170 Government; and 11
171171 (2) no funds, including applicable surcharges, 12
172172 are disbursed to any recipient designated in section 13
173173 106 until the total cost of designing and issuing all 14
174174 of the coins authorized by this Act (including labor, 15
175175 materials, dies, use of machinery, overhead expenses, 16
176176 marketing, and shipping) is recovered by the United 17
177177 States Treasury, consistent with sections 5112(m) 18
178178 and 5134(f) of title 31, United States Code. 19
