A BILL 
To require the Secretary of the Treasury to mint and issue 
coins that are emblematic of the National Fallen Fire-
fighters Memorial and the service and sacrifice of fire-
fighters throughout the history of the United States. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 101. SHORT TITLE. 3
This Act may be cited as the ‘‘National Fallen Fire-4
fighters Memorial Coin Act’’. 5

SEC. 102. COIN SPECIFICATIONS. 1
(a) D
ENOMINATIONS.—The Secretary of the Treas-2
ury (hereafter in this Act referred to as the ‘‘Secretary’’) 3
shall mint and issue the following coin: 4
(1) $5 
GOLD COINS.—Not more than 50,000 $5 5
coins, which shall— 6
(A) weigh 8.359 grams; 7
(B) have a diameter of 0.850 inches; and 8
(C) contain not less than 90 percent gold. 9
(2) $1 
SILVER COINS.—Not more than 400,000 10
$1 coins, which shall— 11
(A) weigh 26.73 grams; 12
(B) have a diameter of 1.500 inches; and 13
(C) contain not less than 90 percent silver. 14
(3) H
ALF-DOLLAR CLAD COINS .—Not more 15
than 750,000 half-dollar coins which shall— 16
(A) weigh 11.34 grams; 17
(B) have a diameter of 1.205 inches; and 18
(C) be minted to the specifications for half- 19
dollar coins contained in section 5112(b) of title 20
31, United States Code. 21
(b) L
EGALTENDER.—The coins minted under this 22
Act shall be legal tender, as provided in section 5103 of 23
title 31, United States Code. 24

(c) NUMISMATICITEMS.—For purposes of section 1
5134 of title 31, United States Code, all coins minted 2
under this Act shall be considered to be numismatic items. 3
SEC. 103. DESIGN OF COINS. 4
(a) D
ESIGNREQUIREMENTS.— 5
(1) I
N GENERAL.—The design of the coins 6
minted under this Act shall be emblematic of the 7
National Fallen Firefighters Memorial and the serv-8
ice and sacrifice of firefighters throughout the his-9
tory of the United States. 10
(2) D
ESIGNATION AND INSCRIPTIONS .—On 11
each coin minted under this Act there shall be— 12
(A) a designation of the value of the coin; 13
(B) an inscription of the year ‘‘2026’’; and 14
(C) inscriptions of the words ‘‘Liberty’’, 15
‘‘In God We Trust’’, ‘‘United States of Amer-16
ica’’, and ‘‘E Pluribus Unum’’. 17
(b) S
ELECTION.—The design for the coins minted 18
under this Act shall be— 19
(1) selected by the Secretary after consultation 20
with the Commission of Fine Arts and the National 21
Fallen Firefighters Foundation; and 22
(2) reviewed by the Citizens Coinage Advisory 23
Committee. 24

SEC. 104. ISSUANCE OF COINS. 1
(a) Q
UALITY OFCOINS.—Coins minted under this 2
Act shall be issued in uncirculated and proof qualities. 3
(b) M
INTFACILITIES.—Only 1 facility of the United 4
States Mint may be used to strike any particular quality 5
of the coins minted under this Act. 6
(c) P
ERIOD FORISSUANCE.—The Secretary may 7
issue coins minted under this Act only during the 1-year 8
period beginning on January 1, 2026. 9
SEC. 105. SALE OF COINS. 10
(a) S
ALEPRICE.—The coins issued under this Act 11
shall be sold by the Secretary at a price equal to the sum 12
of— 13
(1) the face value of the coins; 14
(2) the surcharge provided in section 106(a) 15
with respect to such coins; and 16
(3) the cost of designing and issuing the coins 17
(including labor, materials, dies, use of machinery, 18
overhead expenses, marketing, and shipping). 19
(b) B
ULKSALES.—The Secretary shall make bulk 20
sales of the coins issued under this Act at a reasonable 21
discount. 22
(c) P
REPAIDORDERS.— 23
(1) I
N GENERAL.—The Secretary shall accept 24
prepaid orders for the coins minted under this Act 25
before the issuance of such coins. 26

(2) DISCOUNT.—Sale prices with respect to pre-1
paid orders under paragraph (1) shall be at a rea-2
sonable discount. 3
SEC. 106. SURCHARGES. 4
(a) I
NGENERAL.—All sales of coins issued under this 5
Act shall include a surcharge of— 6
(1) $35 per coin for the $5 coin; 7
(2) $10 per coin for the $1 coin; and 8
(3) $5 per coin for the half-dollar coin. 9
(b) D
ISTRIBUTION.—Subject to section 5134(f)(1) of 10
title 31, United States Code, all surcharges received by 11
the Secretary from the sale of coins issued under this Act 12
shall be promptly paid by the Secretary to the National 13
Fallen Firefighters Foundation to support the mission and 14
programs of the Foundation. 15
(c) A
UDITS.—The National Fallen Firefighters 16
Foundation shall be subject to the audit requirements of 17
section 5134(f)(2) of title 31, United States Code, with 18
regard to the amounts received under subsection (b). 19
(d) L
IMITATION.—Notwithstanding subsection (a), 20
no surcharge may be included with respect to the issuance 21
under this Act of any coin during a calendar year if, as 22
of the time of such issuance, the issuance of such coin 23
would result in the number of commemorative coin pro-24
grams issued during such year to exceed the annual 2 25

commemorative coin program issuance limitation under 1
section 5112(m)(1) of title 31, United States Code (as in 2
effect on the date of the enactment of this Act). The Sec-3
retary of the Treasury may issue guidance to carry out 4
this subsection. 5
SEC. 107. FINANCIAL ASSURANCES. 6
The Secretary shall take such actions as may be nec-7
essary to ensure that— 8
(1) minting and issuing coins under this Act 9
will not result in any net cost to the United States 10
Government; and 11
(2) no funds, including applicable surcharges, 12
are disbursed to any recipient designated in section 13
106 until the total cost of designing and issuing all 14
of the coins authorized by this Act (including labor, 15
materials, dies, use of machinery, overhead expenses, 16
marketing, and shipping) is recovered by the United 17
States Treasury, consistent with sections 5112(m) 18
and 5134(f) of title 31, United States Code. 19
