A BILL 
To prohibit the use of appropriated funds to eliminate, con-
solidate, or otherwise restructure any office within the 
Department of Education that administers or enforces 
programs under the Individuals with Disabilities Edu-
cation Act, and for other purposes. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Protecting Students 4
with Disabilities Act’’. 5
SEC. 2. FINDINGS. 6
Congress finds the following: 7

(1) Section 1402 of the Individuals with Dis-1
abilities Education Act explicitly states that the Of-2
fice of Special Education Programs shall be housed 3
within the Department of Education and tasked with 4
administering and carrying out programs and activi-5
ties concerning the education of children with dis-6
abilities. 7
(2) The executive branch does not have the uni-8
lateral authority to alter this statutory framework. 9
This Act reaffirms Congress’s intent and ensures 10
compliance with existing statute. 11
SEC. 3. PROHIBITION. 12
None of the funds made available by Acts making ap-13
propriations may be used to— 14
(1) eliminate, consolidate, or otherwise restruc-15
ture any office within the Department of Education 16
that administers or enforces programs under the In-17
dividuals with Disabilities Education Act (20 U.S.C. 18
1400 et seq.); 19
(2) terminate, reassign, or alter the responsibil-20
ities of any personnel of any such office; or 21
(3) contract with, or delegate to, any entity out-22
side of the Department of Education to administer 23
or enforce such programs. 24
