2929 NGENERAL.—Chapter 401 of title 49, United 3
3030 States Code, is amended by adding at the end the fol-4
3131 lowing: 5
3232 ‘‘§ 40133. Limitation on mass layoffs in event of major 6
3333 aviation accident. 7
3434 ‘‘(a) L
3535 IMITATION ONMASSLAYOFFS.—Except as 8
3636 provided in subparagraph (b), the Administrator of the 9
3737 Federal Aviation Administration may not carry out, or 10
3838 otherwise facilitate, a mass layoff during the 1-year period 11
3939 following a major aviation accident in air transportation. 12

4141 ONGRESSIONAL APPROVAL FOR MASSLAY-13

4343 ‘‘(1) N
4444 OTIFICATION.—Before carrying out a 15
4545 mass layoff described in subsection (a), the Adminis-16
4646 trator shall submit to Congress notification of such 17
4747 a layoff that includes the number and type of em-18
4848 ployees proposed to be laid off. 19
4949 ‘‘(2) C
5050 ONGRESSIONAL APPROVAL .—In any case 20
5151 in which, not later than 60 days after receipt of a 21
5252 notification under paragraph (1), Congress enacts a 22
5353 joint resolution approving the proposed mass layoff 23
5454 for which such notification was submitted, the Ad-24
5555 ministrator may carry out such mass layoff. 25

5757 EFINITIONS.—In this section: 26

6161 ‘‘(1) MASS LAYOFF.—The term ‘mass layoff’ 1
6262 means a reduction in force or other termination of 2
6363 employment that results in a personnel loss during 3
6464 any 90-day period— 4
6565 ‘‘(A) of 10 or more employees of the Fed-5
6666 eral Aviation Administration at a single site of 6
6767 employment, as calculated under paragraph (2); 7
6868 or 8
6969 ‘‘(B) of 250 or more employees of the Ad-9
7070 ministration, irrespective of employment site. 10
7171 ‘‘(2) C
7272 ALCULATION.—The number of employees 11
7373 at a single site of employment who suffer an employ-12
7474 ment loss shall be calculated in a manner that in-13
7575 cludes— 14
7676 ‘‘(A) all such employees who work at the 15
7777 physical location of the site; and 16
7878 ‘‘(B) all such employees who work remotely 17
7979 and— 18
8080 ‘‘(i) are assigned to or otherwise asso-19
8181 ciated with the site; 20
8282 ‘‘(ii) receive assignments or training 21
8383 from the site; 22
8484 ‘‘(iii) report to a manager associated 23
8585 with the site; or 24

8989 ‘‘(iv) whose job loss was a foreseeable 1
9090 consequence of a reduction in force or 2
9191 other termination of employment at the 3
9292 site. 4
9393 ‘‘(3) M
9494 AJOR AVIATION ACCIDENT .—The term 5
9595 ‘‘major aviation accident’’ means an aircraft acci-6
9696 dent in which a fatal aviation injury occurs. 7
9797 ‘‘(4) A
9898 IRCRAFT ACCIDENT.—The term ‘aircraft 8
9999 accident’ means an occurrence associated with the 9
100100 operation of a civil aircraft that takes place between 10
101101 the time any individual boards the aircraft with the 11
102102 intention of flight and the time at which the last in-12
103103 dividual disembarks such aircraft in which any indi-13
104104 vidual suffers death or serious injury, or in which 14
105105 the aircraft receives substantial damage. 15
106106 ‘‘(5) F
107107 ATAL AVIATION INJURY.—The term ‘fatal 16
108108 aviation injury’ means any injury due to an aircraft 17
109109 accident that results in the death of an individual as 18
110110 a result of such accident within 30 days of such ac-19
111111 cident.’’. 20

113113 LERICALAMENDMENT.—The analysis for chap-21
114114 ter 401 of title 49, United States Code, is amended by 22
115115 adding at the end the following: 23
116116 ‘‘40133. Limitation on reduction in force.’’.
