LIMITATION ON MASS LAYOFFS IN EVENT OF 1 MAJOR AVIATION ACCIDENT. 2 (a) I NGENERAL.—Chapter 401 of title 49, United 3 States Code, is amended by adding at the end the fol-4 lowing: 5 ‘‘§ 40133. Limitation on mass layoffs in event of major 6 aviation accident. 7 ‘‘(a) L IMITATION ONMASSLAYOFFS.—Except as 8 provided in subparagraph (b), the Administrator of the 9 Federal Aviation Administration may not carry out, or 10 otherwise facilitate, a mass layoff during the 1-year period 11 following a major aviation accident in air transportation. 12 ‘‘(b) C ONGRESSIONAL APPROVAL FOR MASSLAY-13 OFF.— 14 ‘‘(1) N OTIFICATION.—Before carrying out a 15 mass layoff described in subsection (a), the Adminis-16 trator shall submit to Congress notification of such 17 a layoff that includes the number and type of em-18 ployees proposed to be laid off. 19 ‘‘(2) C ONGRESSIONAL APPROVAL .—In any case 20 in which, not later than 60 days after receipt of a 21 notification under paragraph (1), Congress enacts a 22 joint resolution approving the proposed mass layoff 23 for which such notification was submitted, the Ad-24 ministrator may carry out such mass layoff. 25 ‘‘(c) D EFINITIONS.—In this section: 26 VerDate Sep 11 2014 21:12 Apr 15, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2431.IH H2431 ssavage on LAPJG3WLY3PROD with BILLS 3 •HR 2431 IH ‘‘(1) MASS LAYOFF.—The term ‘mass layoff’ 1 means a reduction in force or other termination of 2 employment that results in a personnel loss during 3 any 90-day period— 4 ‘‘(A) of 10 or more employees of the Fed-5 eral Aviation Administration at a single site of 6 employment, as calculated under paragraph (2); 7 or 8 ‘‘(B) of 250 or more employees of the Ad-9 ministration, irrespective of employment site. 10 ‘‘(2) C ALCULATION.—The number of employees 11 at a single site of employment who suffer an employ-12 ment loss shall be calculated in a manner that in-13 cludes— 14 ‘‘(A) all such employees who work at the 15 physical location of the site; and 16 ‘‘(B) all such employees who work remotely 17 and— 18 ‘‘(i) are assigned to or otherwise asso-19 ciated with the site; 20 ‘‘(ii) receive assignments or training 21 from the site; 22 ‘‘(iii) report to a manager associated 23 with the site; or 24 VerDate Sep 11 2014 21:12 Apr 15, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2431.IH H2431 ssavage on LAPJG3WLY3PROD with BILLS 4 •HR 2431 IH ‘‘(iv) whose job loss was a foreseeable 1 consequence of a reduction in force or 2 other termination of employment at the 3 site. 4 ‘‘(3) M AJOR AVIATION ACCIDENT .—The term 5 ‘‘major aviation accident’’ means an aircraft acci-6 dent in which a fatal aviation injury occurs. 7 ‘‘(4) A IRCRAFT ACCIDENT.—The term ‘aircraft 8 accident’ means an occurrence associated with the 9 operation of a civil aircraft that takes place between 10 the time any individual boards the aircraft with the 11 intention of flight and the time at which the last in-12 dividual disembarks such aircraft in which any indi-13 vidual suffers death or serious injury, or in which 14 the aircraft receives substantial damage. 15 ‘‘(5) F ATAL AVIATION INJURY.—The term ‘fatal 16 aviation injury’ means any injury due to an aircraft 17 accident that results in the death of an individual as 18 a result of such accident within 30 days of such ac-19 cident.’’. 20 (b) C LERICALAMENDMENT.—The analysis for chap-21 ter 401 of title 49, United States Code, is amended by 22 adding at the end the following: 23 ‘‘40133.
