SHORT TITLE. 3 This Act may be cited as the ‘‘Save Our Small Farms 4 Act of 2025’’. 5 SEC. 2. ADMINISTRATION AND OPERATION OF NON-6 INSURED CROP ASSISTANCE PROGRAM. 7 Section 196 of the Federal Agriculture Improvement 8 and Reform Act of 1996 (7 U.S.C. 7333) is amended— 9 (1) in subsection (a)(1)(C)— 10 (A) in the matter preceding clause (i), by 11 inserting ‘‘best facilitates’’ after ‘‘assistance 12 program that’’; 13 (B) in clause (i)— 14 (i) by striking ‘‘best facilitates the use 15 of that’’ and inserting ‘‘the use of those’’; 16 and 17 (ii) by striking ‘‘and’’ at the end; 18 (C) in clause (ii)— 19 (i) by striking ‘‘ensures the avail-20 ability of that’’ and inserting ‘‘the public 21 availability of those’’; and 22 (ii) by striking the period at the end 23 and inserting a semicolon; and 24 (D) by adding at the end the following: 25 VerDate Sep 11 2014 02:02 Apr 05, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2435.IH H2435 abielarski on DSK125SN23PROD with BILLS 3 •HR 2435 IH ‘‘(iii) the expansion of crops listed on 1 the national crop table of the Agency with 2 a local average market price; 3 ‘‘(iv) the voluntary graduation of pro-4 gram participants to the whole farm risk 5 management insurance plan developed 6 under section 522(c)(7) of the Federal 7 Crop Insurance Act (7 U.S.C. 1522(c)(7)); 8 and 9 ‘‘(v) the establishment of pilot 10 projects for purposes of addressing emerg-11 ing needs of producers and collecting data 12 to support the development of policies or 13 plans of insurance offered under the Fed-14 eral Crop Insurance Act (7 U.S.C. 1501 et 15 seq.).’’; 16 (2) in subsection (b), by striking paragraph (4) 17 and inserting the following: 18 ‘‘(4) S TREAMLINED APPLICATION PROCESS .— 19 ‘‘(A) D EFINITION OF WHOLE FARM 20 PLAN.—In this paragraph, the term ‘whole 21 farm plan’ means the whole farm risk manage-22 ment insurance plan developed under section 23 522(c)(7) of the Federal Crop Insurance Act (7 24 U.S.C. 1522(c)(7)). 25 VerDate Sep 11 2014 02:02 Apr 05, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2435.IH H2435 abielarski on DSK125SN23PROD with BILLS 4 •HR 2435 IH ‘‘(B) ESTABLISHMENT.— 1 ‘‘(i) I N GENERAL.—The Secretary 2 shall establish a streamlined process for 3 the submission of records and acreage re-4 ports under paragraphs (2) and (3), re-5 spectively, for— 6 ‘‘(I) diverse production systems, 7 such as those typical of urban produc-8 tion systems; 9 ‘‘(II) other small-scale production 10 systems; and 11 ‘‘(III) direct-to-consumer produc-12 tion systems. 13 ‘‘(ii) I NCLUSIONS.—The streamlined 14 process established under clause (i) shall 15 include— 16 ‘‘(I) reduced acreage report re-17 quirements; and 18 ‘‘(II) allowing the submission to 19 the Secretary of 2 reports per year so 20 as to accommodate later acreage re-21 porting. 22 ‘‘(C) R EVENUE-BASED OPTION.— 23 ‘‘(i) E STABLISHMENT.—Notwith-24 standing paragraphs (2) and (3) or sub-25 VerDate Sep 11 2014 02:02 Apr 05, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H2435.IH H2435 abielarski on DSK125SN23PROD with BILLS 5 •HR 2435 IH section (a)(1)(A), the Secretary shall es-1 tablish a streamlined revenue-based cov-2 erage option that is available, on a vol-3 untary basis, to any producer eligible for 4 assistance under this section. 5 ‘‘(ii) S UBMISSION OF HISTORICAL 6 REVENUE.—The Secretary shall accept the 7 Internal Revenue Service Tax Form Sched-8 ule F, or successor forms, as sufficient for 9 the establishment of historical adjusted 10 revenue, subject to the condition that ap-11 proved insurance providers may request 12 additional verifiable records in cases where 13 there is documented evidence, made clear 14 to the applicant, that farm tax records are 15 incomplete. 16 ‘‘(D) O N-RAMP TO WHOLE FARM PLAN .— 17 ‘‘(i) I N GENERAL.—In the case of a 18 producer using diverse production systems 19 described in subparagraph (B)(i) that may 20 be eligible for the whole farm plan, the 21 Secretary, acting through the Adminis-22 trator of the Agency, shall establish a 23 streamlined revenue-based option under 24 the noninsured crop disaster assistance 25 VerDate Sep 11 2014 02:02 Apr 05, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H2435.IH H2435 abielarski on DSK125SN23PROD with BILLS 6 •HR 2435 IH program under this section to assist the 1 producer to transition, on a voluntary 2 basis, from the noninsured crop disaster 3 assistance program under this section to 4 the whole farm plan. The Secretary may 5 provide for such other options as may be 6 necessary to assist producers with such a 7 transition who are unable to purchase a 8 whole farm plan. 9 ‘‘(ii) R EQUIREMENTS.—The stream-10 lined revenue-based option established 11 under clause (i) shall offer a premium dis-12 count of— 13 ‘‘(I) 25 percent for the first crop 14 year for which a producer— 15 ‘‘(aa) certifies that the pro-16 ducer will transition from the 17 noninsured crop disaster assist-18 ance program under this section 19 to the whole farm plan not later 20 than 3 years after the date of the 21 certification; and 10 ‘‘(bb) provides revenue his-11 tory with respect to that crop 12 year; and 13 ‘‘(III) 50 percent for the crop 14 year following the crop year described 15 in subclause (II) if the producer— 16 ‘‘(aa) purchases insurance 17 under the whole farm plan not 18 later than 1 year after the date 19 of the certification; and 20 ‘‘(bb) provides revenue his-21 tory with respect to that crop 22 year. 23 ‘‘(iii) T AX FORM SCHEDULE F .—The 24 Secretary shall accept the Internal Rev-25 VerDate Sep 11 2014 02:02 Apr 05, 2025 Jkt 059200 PO 00000 Frm 00007 Fmt 6652 Sfmt 6201 E:\BILLS\H2435.IH H2435 abielarski on DSK125SN23PROD with BILLS 8 •HR 2435 IH enue Service Tax Form Schedule F (or a 1 successor form) with respect to a producer 2 for purposes of establishing revenue history 3 under clause (ii). 4 ‘‘(iv) R EVENUE HISTORY SHARING .— 5 The Secretary shall submit to the Federal 6 Crop Insurance Corporation the revenue 7 history submitted to the Secretary pursu-8 ant to clause (ii). 9 ‘‘(E) R ULEMAKING.—Not later than 90 10 days after the date of the enactment of the 11 Save Our Small Farms Act of 2025, the Sec-12 retary shall issue regulations to ensure that 13 premium discounts under this paragraph are 14 only available to producers who transition to a 15 whole farm plan, as described in subparagraph 16 (D)(i).’’; 17 (3) in subsection (c), by adding at the end the 18 following: 19 ‘‘(5) N OTICE OF CERTAIN LOSSES .—Notwith-20 standing any other provision of law (including regu-21 lations), a producer of a hand-harvested or rapidly 22 deteriorating crop may submit to the Secretary noti-23 fication of a loss of that crop 120 hours or more 24 VerDate Sep 11 2014 02:02 Apr 05, 2025 Jkt 059200 PO 00000 Frm 00008 Fmt 6652 Sfmt 6201 E:\BILLS\H2435.IH H2435 abielarski on DSK125SN23PROD with BILLS 9 •HR 2435 IH after the loss in order to be eligible for assistance 1 under this section. 2 ‘‘(6) A PPRAISAL OF LOSS.— 3 ‘‘(A) I N GENERAL.—In any case in which 4 an appraisal of crop acreage is requested by a 5 producer or determined to be necessary by the 6 Secretary for a year in which a notice of loss 7 is filed under this subsection, particularly in 8 any case in which a loss adjuster is not avail-9 able within 72 hours of the notice, the Sec-10 retary shall permit the following alternatives to 11 an in-person appraisal by a loss adjuster: 12 ‘‘(i) Remote appraisal, including time- 13 stamped photographs, drone footage, and 14 other technology applications. 15 ‘‘(ii) Appraisal by field office staff of 16 the Agency with requisite training, in con-17 junction with a remote appraisal under 18 clause (i). 19 ‘‘(B) T RAINING.—The Secretary shall re-20 quire field office staff to attend noninsured crop 21 disaster assistance appraisal training for pur-22 poses of subparagraph (A)(ii).’’; 3 (B) in subparagraph (B), by striking the 4 period at the end and inserting ‘‘; and’’; and 5 (C) by adding at the end the following: 6 ‘‘(C) notwithstanding subparagraphs (A) 7 and (B), in the case of a limited resource, be-8 ginning, or socially disadvantaged farmer, as 9 determined by the Secretary, a veteran farmer 10 or rancher (as defined in section 2501(a) of the 11 Food, Agriculture, Conservation, and Trade Act 12 of 1990 (7 U.S.C. 2279(a))), or a producer par-13 ticipating in the streamlined revenue-based op-14 tion pursuant to subsection (b)(4)(C), 15 $600,000.’’; 16 (6) in subsection (k)(2)— 17 (A) by striking ‘‘defined by the Secretary, 18 or a veteran’’ and inserting ‘‘determined by the 19 Secretary, a veteran’’; and 20 (B) by inserting ‘‘, or a producer partici-21 pating in the streamlined revenue-based option 22 pursuant to subsection (b)(4)(C)’’ before the 23 period at the end; 24 VerDate Sep 11 2014 02:02 Apr 05, 2025 Jkt 059200 PO 00000 Frm 00010 Fmt 6652 Sfmt 6201 E:\BILLS\H2435.IH H2435 abielarski on DSK125SN23PROD with BILLS 11 •HR 2435 IH (7) in subsection (l), by striking paragraph (3) 1 and inserting the following: 2 ‘‘(3) P REMIUM DISCOUNT.—The coverage made 3 available under this subsection shall be available to 4 limited resource, beginning, or socially disadvan-5 taged farmers, as determined by the Secretary, vet-6 eran farmers or ranchers (as defined in section 7 2501(a) of the Food, Agriculture, Conservation, and 8 Trade Act of 1990 (7 U.S.C. 2279(a))), and pro-9 ducers participating in the streamlined revenue- 10 based option pursuant to subsection (b)(4)(C), in ex-11 change for a premium that is 25 percent of the pre-12 mium determined under paragraph (2).’’; and 13 (8) by adding at the end the following: 14 ‘‘(m) D ELIVERY.—The Secretary shall collaborate 15 with outreach and technical assistance providers, exten-16 sion offices, and State departments of agriculture to ad-17 vertise the noninsured crop disaster assistance program 18 under this section, particularly to limited resource, begin-19 ning, or socially disadvantaged farmers, as determined by 20 the Secretary, veteran farmers or ranchers (as defined in 21 section 2501(a) of the Food, Agriculture, Conservation, 22 and Trade Act of 1990 (7 U.S.C. 2279(a))), and pro-23 ducers eligible to participate in the streamlined revenue- 24 based option pursuant to subsection (b)(4)(C).’’. 25 VerDate Sep 11 2014 02:02 Apr 05, 2025 Jkt 059200 PO 00000 Frm 00011 Fmt 6652 Sfmt 6201 E:\BILLS\H2435.IH H2435 abielarski on DSK125SN23PROD with BILLS 12 •HR 2435 IH SEC. 3. WHOLE FARM REVENUE PROTECTION. 1 Section 522(c) of the Federal Crop Insurance Act (7 2 U.S.C. 1522(c)) is amended— 3 (1) in paragraph (1)— 4 (A) in subparagraph (B), by striking 5 ‘‘and’’ at the end; 6 (B) in subparagraph (C), by striking the 7 period at the end and inserting ‘‘; and’’; and 8 (C) by adding at the end the following: 9 ‘‘(D) increase participation by producers— 10 ‘‘(i) marketing direct-to-consumers; 11 ‘‘(ii) marketing through intermediated 12 sales in local and regional markets; 13 ‘‘(iii) using farm identity-preserved 14 marketing; or 15 ‘‘(iv) undertaking producer education 16 on how to use direct market prices.’’; 17 (2) in paragraph (7)— 18 (A) in subparagraph (A), by striking ‘‘, 19 with a liability limitation of $1,500,000,’’; 20 (B) in subparagraph (B), by inserting ‘‘or 21 in combination with’’ after ‘‘in lieu of’’; or’’; 10 (D) in subparagraph (D), by striking 11 ‘‘may’’ and inserting ‘‘shall’’; 12 (E) in subparagraph (E)— 13 (i) in clause (i), in the matter pre-14 ceding subclause (I), by striking ‘‘18 15 months after the date of enactment of the 16 Agriculture Improvement Act of 2018’’ 17 and inserting ‘‘1 year after the date of the 18 enactment of the Save Our Small Farms 19 Act of 2025’’; and 14 ‘‘(II) submit to the Committee on 15 Agriculture of the House of Rep-16 resentatives and the Committee on 17 Agriculture, Nutrition, and Forestry 18 of the Senate a report that includes a 19 summary of the most recent review 20 conducted under subclause (I) and 21 any expected changes to the policy for 22 the following reinsurance year. 23 ‘‘(iv) P UBLIC REPORT.—Not later 24 than 18 months after the date of the en-25 VerDate Sep 11 2014 02:02 Apr 05, 2025 Jkt 059200 PO 00000 Frm 00014 Fmt 6652 Sfmt 6201 E:\BILLS\H2435.IH H2435 abielarski on DSK125SN23PROD with BILLS 15 •HR 2435 IH actment of the Save Our Small Farms Act 1 of 2025, the Board shall make publicly 2 available a report describing the decisions 3 made by the Board with respect to each 4 factor described in clause (ii).’’; 5 (F) by redesignating subparagraph (F) as 6 subparagraph (G); and 7 (G) by inserting after subparagraph (E) 8 the following: 9 ‘‘(F) M ODIFICATIONS TO IMPROVE EFFEC -10 TIVENESS FOR SPECIALTY CROPS AND DIVERSI -11 FIED FARMS.— 12 ‘‘(i) I N GENERAL.—Not later than 18 13 months after the date of the enactment of 14 the Save Our Small Farms Act of 2025, 15 the Corporation shall implement the fol-16 lowing modifications to the plan developed 17 under subparagraph (A): 18 ‘‘(I) Establish that appropriate 19 income reported on Internal Revenue 20 Service Tax Form Schedule F (or a 21 successor form), shall be sufficient for 22 the establishment of historical ad-23 justed revenue, subject to the condi-24 tion that approved insurance providers 25 VerDate Sep 11 2014 02:02 Apr 05, 2025 Jkt 059200 PO 00000 Frm 00015 Fmt 6652 Sfmt 6201 E:\BILLS\H2435.IH H2435 abielarski on DSK125SN23PROD with BILLS 16 •HR 2435 IH may request additional verifiable 1 records in cases where there is docu-2 mented evidence, made clear to the 3 applicant, that farm tax records are 4 incomplete. 5 ‘‘(II) Presume that declines in 6 total market price are due to unavoid-7 able natural causes, unless the Cor-8 poration demonstrates the extent to 9 which the decline in lower market 10 price is the direct result of an unin-11 sured manmade event. 12 ‘‘(III) Require that any adjust-13 ment of the revenue guarantee by an 14 approved insurance provider, after the 15 approved insurance provider accepts a 16 revised farm operation report from 17 the insured, is contingent on approval 18 from the Risk Management Agency, 19 and allow the insured an opportunity 20 to appeal any denial by the Risk Man-21 agement Agency of that revenue guar-22 antee adjustment to the National Ap-23 peals Division. 24 VerDate Sep 11 2014 02:02 Apr 05, 2025 Jkt 059200 PO 00000 Frm 00016 Fmt 6652 Sfmt 6201 E:\BILLS\H2435.IH H2435 abielarski on DSK125SN23PROD with BILLS 17 •HR 2435 IH ‘‘(IV) With respect to whole farm 1 revenue protection policies, raise the 2 limit on growth expansion for all pro-3 ducers to the lower of— 4 ‘‘(aa) 100 percent of historic 5 revenue; and 6 ‘‘(bb) $500,000. 7 ‘‘(V) In the case of a rejection of 8 an application from a producer for a 9 whole farm insurance plan, the ap-10 proved insurance provider involved 11 shall notify the producer of such re-12 jection, and include in such notifica-13 tion a written rationale with sufficient 14 detail for the producer to understand 15 any deficiencies in the application and 16 how to cure those deficiencies. 17 ‘‘(VI) Expand the maximum 18 commodity count eligible for the diver-19 sification-based premium discount 20 under subparagraph (C) to apply to 21 10 commodities produced. or 13 ‘‘(bb) using an assigned 14 yield floor similar to the limita-15 tion described in section 16 508(g)(6)(A)(i), as determined by 17 the Secretary. 18 ‘‘(VIII) Allow prices and yields 19 used to establish coverage in other 20 Federal crop insurance policies to be 21 used as prices and yields for whole 22 farm revenue protection policies. 23 ‘‘(IX) Establish a process for 24 records and acreage reports submitted 25 VerDate Sep 11 2014 02:02 Apr 05, 2025 Jkt 059200 PO 00000 Frm 00018 Fmt 6652 Sfmt 6201 E:\BILLS\H2435.IH H2435 abielarski on DSK125SN23PROD with BILLS 19 •HR 2435 IH by producers for the noninsured crop 1 disaster assistance program estab-2 lished by section 196 of the Federal 3 Agriculture Improvement and Reform 4 Act of 1996 (7 U.S.C. 7333) to be ac-5 cepted as documentation for the req-6 uisite actual production history for 7 whole farm revenue protection poli-8 cies. 9 ‘‘(X) Increase agent incentives to 10 market whole farm revenue protection 11 by— 12 ‘‘(aa) providing annual addi-13 tional administrative and oper-14 ating subsidies, at a rate deter-15 mined by the Secretary, to ap-16 proved insurance providers for 17 any new whole farm revenue poli-18 cies written in a given year; and 9 ‘‘(II) may consult with licensed 10 actuaries with experience developing 11 index policies insuring agricultural 12 production. 13 ‘‘(C) R EPORT.—Not later than 1 year 14 after the date of the enactment of this para-15 graph, the Corporation shall make publicly 16 available a report that describes— 17 ‘‘(i) the results of the research and 18 development carried out under this para-19 graph;
