To amend the Workforce Innovation and Opportunity Act
to clarify the procedures regarding the eligibility of online
providers of training services.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Ensuring Opportuni-4
ties in Online Training Act’’. 5
SEC. 2. ELIGIBLE ONLINE PROVIDERS. 6
Section 122(c) of the Workforce Innovation and Op-7
portunity Act (29 U.S.C. 3152(c)) is amended by adding 8
at the end the following: 9

‘‘(3) ONLINE PROVIDERS.—The procedures es-1
tablished under subsection (a) shall apply to a pro-2
vider that delivers training services exclusively on-3
line. If a participant chooses a provider that delivers 4
training services exclusively online and is not located 5
in the State of the local area that approved such 6
training services for the participant in accordance 7
with section 134(c)(3)(A)(i), such provider shall be 8
ineligible to receive payment for such participant 9
from funds allotted to such State under section 132 10
unless such provider is on the list of eligible pro-11
viders of training services described in subsection (d) 12
for such State with respect to the program in-13
volved.’’. 14
