| 38 | 38 | | utility, the Secretary concerned may provide permission to 5 |

| 39 | 39 | | cut and remove trees or other vegetation from within the 6 |
|---|
| 40 | 40 | | vicinity of distribution lines or transmission lines without 7 |
|---|
| 41 | 41 | | requiring a separate timber sale, if that cutting and re-8 |
|---|
| 42 | 42 | | moval is consistent with— 9 |
|---|
| 43 | 43 | | (1) any applicable land and resource manage-10 |
|---|
| 44 | 44 | | ment plan; and 11 |
|---|
| 45 | 45 | | (2) other applicable environmental laws (includ-12 |

| 48 | 48 | | SE OFPROCEEDS.—A special use permit or 14 |
|---|
| 49 | 49 | | easement that includes permission for cutting and removal 15 |

| 50 | 50 | | described in subsection (a) shall include a requirement 16 |

| 51 | 51 | | that, if the applicable electrical utility sells any portion 17 |
|---|
| 52 | 52 | | of the material removed under the permit or easement, 18 |
|---|
| 53 | 53 | | the electrical utility shall provide to the Secretary con-19 |
|---|
| 54 | 54 | | cerned any proceeds received from the sale, less any trans-20 |
|---|
| 55 | 55 | | portation costs incurred in the sale. 21 |
