SHORT TITLE. 3 This Act may be cited as the ‘‘Improving Reporting 4 to Prevent Hate Act of 2025’’. 5 SEC. 2. REQUIREMENT TO CREDIBLY REPORT HATE 6 CRIMES. 7 Section 505 of the Omnibus Crime Control and Safe 8 Streets Act of 1968 (34 U.S.C. 10156) is amended by 9 adding at the end the following: 10 VerDate Sep 11 2014 01:36 Apr 09, 2025 Jkt 059200 PO 00000 Frm 00001 Fmt 6652 Sfmt 6201 E:\BILLS\H2588.IH H2588 ssavage on LAPJG3WLY3PROD with BILLS 2 •HR 2588 IH ‘‘(j) EVALUATION FOR REPORTING ON HATE 1 C RIMES.—Beginning not later than three years after the 2 date of the enactment of this Act and from the data ac-3 quired by the Attorney General in accordance with the 4 Hate Crimes Statistics Act (34 U.S.C. 41305), the Attor-5 ney General shall establish a method of evaluating and use 6 such method to evaluate whether a covered jurisdiction 7 has credibly reporting hate crimes, including whether, for 8 each year, a covered jurisdiction— 9 ‘‘(1) has not reported hate crime data to the 10 Federal Bureau of Investigation; or 11 ‘‘(2) has reported zero hate crime incidents to 12 the Federal Bureau of Investigation. 13 ‘‘(k) E LIGIBILITY.— 14 ‘‘(1) I N GENERAL.—A covered jurisdiction that 15 is found not to have credibly reported hate crimes 16 following an evaluation pursuant to subsection (j) 17 shall not be eligible for an allocation under this sec-18 tion. 19 ‘‘(2) E XCEPTION.—A covered jurisdiction that 20 is found not to have credibly reported hate crimes 21 following an evaluation pursuant to subsection (j) 22 shall not be subject to a penalty under paragraph 23 (1) if the Attorney General certifies that the covered 24 jurisdiction has conducted significant community 25 VerDate Sep 11 2014 01:36 Apr 09, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2588.IH H2588 ssavage on LAPJG3WLY3PROD with BILLS 3 •HR 2588 IH public education and awareness initiatives on hate 1 crimes. 2 ‘‘(l) A NNUALREPORT.—Each year the Attorney Gen-3 eral shall publish on the internet website of the Depart-4 ment of Justice a report on the covered jurisdictions cer-5 tified under subsection (k)(2). 6 ‘‘(m) D EFINITIONS.—In this section: 7 ‘‘(1) C OVERED JURISDICTION.—The term ‘cov-8 ered jurisdiction’ means a unit of local government 9 that has a requested a grant under this subpart and 10 has a population of over 100,000 people. 11 ‘‘(2) H ATE CRIME.—The term ‘hate crime’ 12 means— 13 ‘‘(A) an act described in section 1(b)(1) of 14 the Hate Crime Statistics Act ((34 U.S.C. 15 41305(1)(b)(1)); and 16 ‘‘(B) an act in violation of sections 241, 17 245, 247, or 249 of title 18, United States 18 Code. 19 ‘‘(3) S IGNIFICANT COMMUNITY PUBLIC EDU -20 CATION AND AWARENESS INITIATIVES ON HATE 21 CRIMES.—The term ‘significant community public 22 education and awareness initiatives on hate crimes’ 23 means that a covered jurisdiction— 24 ‘‘(A) has— 25 VerDate Sep 11 2014 01:36 Apr 09, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2588.IH H2588 ssavage on LAPJG3WLY3PROD with BILLS 4 •HR 2588 IH ‘‘(i) made substantial progress to-1 wards comprehensive reporting hate 2 crimes; 3 ‘‘(ii) adopted a policy on identifying, 4 investigating, and reporting hate crimes; 5 and 6 ‘‘(iii) developed a standardized system 7 of collecting, analyzing, and reporting hate 8 crimes to the National Incident-Based Re-9 porting System of the Federal Bureau of 10 Investigation; or 11 ‘‘(B) may— 12 ‘‘(i) establish a unit or liaison special-13 ized in identifying, investigating, and re-14 porting hate crimes and engaging in com-15 munity relations functions related to pre-16 venting hate crimes; or 17 ‘‘(ii) conduct an ongoing and regular 18 public meetings or educational forums on 19 the impact of hate crimes, services avail-20 able to victims of hate crimes, and any rel-21 evant Federal, State, or local laws related 22 to hate crimes.’’. 23 Æ VerDate Sep 11 2014 01:36 Apr 09, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6301 E:\BILLS\H2588.IH H2588 ssavage on LAPJG3WLY3PROD with BILLS
