1717 SECTION 1. SHORT TITLE. 3
1818 This Act may be cited as the ‘‘Asylum for Farmers 4
1919 and Refugees In Krsis And Necessary Emigration Reset-5
2020 tlement Act’’ or the ‘‘AFRIKANER Act’’. 6
2121 SEC. 2. DESIGNATION OF CERTAIN RESIDENTS OF SOUTH 7
2222 AFRICA AS PRIORITY 2 REFUGEES. 8
2323 (a) I
2424 NGENERAL.—The Secretary of State, in con-9
2525 sultation with the Secretary of Homeland Security, shall 10

2929 designate as Priority 2 refugees of special humanitarian 1
3030 concern the following categories of aliens: 2
3131 (1) Residents of South Africa who are members 3
3232 of the Caucasian minority group and have suffered 4
3333 persecution, or have a well-founded fear of persecu-5
3434 tion, on account of their race, ethnicity, or ancestry. 6
3535 (2) The spouses, children, and parents (as such 7
3636 terms are defined in subsections (a) and (b) of sec-8
3737 tion 101 of the Immigration and Nationality Act (8 9
3838 U.S.C. 1101)) of individuals described in paragraph 10
3939 (1), except such parents who are citizens of a coun-11
4040 try other than South Africa. 12
4141 (b) P
4242 ROCESSING OFSOUTHAFRICANREFUGEES.— 13
4343 The processing of individuals described in subsection (a) 14
4444 for classification as refugees may occur in South Africa 15
4545 or in a third country. 16
4646 (c) E
4747 LIGIBILITY FORADMISSION ASREFUGEES.—An 17
4848 alien may not be denied the opportunity to apply for ad-18
4949 mission as a refugee under this section primarily because 19
5050 such alien— 20
5151 (1) qualifies as an immediate relative of a cit-21
5252 izen of the United States; or 22
5353 (2) is eligible for admission to the United 23
5454 States under any other immigrant classification. 24

5858 (d) FACILITATION OFADMISSIONS.—An applicant 1
5959 for admission to the United States from South Africa may 2
6060 not be denied primarily on the basis of a politically moti-3
6161 vated arrest, detention, or other adverse government ac-4
6262 tion taken against such applicant as a result of the appli-5
6363 cant’s race, ethnicity, or ancestry. 6

6565 XCLUSIONFROMNUMERICALLIMITATIONS.— 7
6666 Aliens provided refugee status under this section shall not 8
6767 be counted against any numerical limitation under section 9
6868 201, 202, 203, or 207 of the Immigration and Nationality 10
6969 Act (8 U.S.C. 1151, 1152, 1153, or 1157). 11

7171 EPORTINGREQUIREMENTS.— 12
7272 (1) I
7373 N GENERAL.—Not later than 180 days 13
7474 after the date of the enactment of this Act, and 14
7575 every 90 days thereafter, the Secretary of State and 15
7676 the Secretary of Homeland Security shall submit a 16
7777 report on the matters described in paragraph (2) 17
7878 to— 18
7979 (A) the Committee on the Judiciary and 19
8080 the Committee on Foreign Relations of the Sen-20
8181 ate; and 21
8282 (B) the Committee on the Judiciary and 22
8383 the Committee on Foreign Affairs of the House 23
8484 of Representatives. 24

8888 (2) MATTERS TO BE INCLUDED .—Each report 1
8989 required by paragraph (1) shall include— 2
9090 (A) the total number of applications that 3
9191 are pending at the end of the reporting period; 4
9292 (B) the average wait-times for all appli-5
9393 cants who are, as of the date of the report, 6
9494 awaiting— 7
9595 (i) employment verification; 8
9696 (ii) a prescreening interview with a re-9
9797 settlement support center; 10
9898 (iii) an interview with U.S. Citizen-11
9999 ship and Immigration Services; and 12
100100 (iv) the completion of security checks; 13
101101 and 14
102102 (C) the number of denials of applications 15
103103 for refugee status, disaggregated by the reason 16
104104 for each such denial. 17
105105 (3) F
106106 ORM.—Each report required by paragraph 18
107107 (1) shall be submitted in unclassified form, but may 19
108108 include a classified annex. 20

110110 UBLIC REPORTS.—The Secretary of State 21
111111 shall make each report submitted under this sub-22
112112 section available to the public on the internet website 23
113113 of the Department of State. 24

117117 (g) SATISFACTION OF OTHERREQUIREMENTS.— 1
118118 Aliens granted status under this section as Priority 2 refu-2
119119 gees of special humanitarian concern under the refugee 3
120120 resettlement priority system shall be considered to satisfy 4
121121 the requirements under section 207 of the Immigration 5
122122 and Nationality Act (8 U.S.C. 1157) for admission to the 6
123123 United States. 7
