A BILL 
To designate residents of South Africa as Priority 2 refugees 
of special humanitarian concern, and for other purposes. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Asylum for Farmers 4
and Refugees In Krsis And Necessary Emigration Reset-5
tlement Act’’ or the ‘‘AFRIKANER Act’’. 6
SEC. 2. DESIGNATION OF CERTAIN RESIDENTS OF SOUTH 7
AFRICA AS PRIORITY 2 REFUGEES. 8
(a) I
NGENERAL.—The Secretary of State, in con-9
sultation with the Secretary of Homeland Security, shall 10

designate as Priority 2 refugees of special humanitarian 1
concern the following categories of aliens: 2
(1) Residents of South Africa who are members 3
of the Caucasian minority group and have suffered 4
persecution, or have a well-founded fear of persecu-5
tion, on account of their race, ethnicity, or ancestry. 6
(2) The spouses, children, and parents (as such 7
terms are defined in subsections (a) and (b) of sec-8
tion 101 of the Immigration and Nationality Act (8 9
U.S.C. 1101)) of individuals described in paragraph 10
(1), except such parents who are citizens of a coun-11
try other than South Africa. 12
(b) P
ROCESSING OFSOUTHAFRICANREFUGEES.— 13
The processing of individuals described in subsection (a) 14
for classification as refugees may occur in South Africa 15
or in a third country. 16
(c) E
LIGIBILITY FORADMISSION ASREFUGEES.—An 17
alien may not be denied the opportunity to apply for ad-18
mission as a refugee under this section primarily because 19
such alien— 20
(1) qualifies as an immediate relative of a cit-21
izen of the United States; or 22
(2) is eligible for admission to the United 23
States under any other immigrant classification. 24

(d) FACILITATION OFADMISSIONS.—An applicant 1
for admission to the United States from South Africa may 2
not be denied primarily on the basis of a politically moti-3
vated arrest, detention, or other adverse government ac-4
tion taken against such applicant as a result of the appli-5
cant’s race, ethnicity, or ancestry. 6
(e) E
XCLUSIONFROMNUMERICALLIMITATIONS.— 7
Aliens provided refugee status under this section shall not 8
be counted against any numerical limitation under section 9
201, 202, 203, or 207 of the Immigration and Nationality 10
Act (8 U.S.C. 1151, 1152, 1153, or 1157). 11
(f) R
EPORTINGREQUIREMENTS.— 12
(1) I
N GENERAL.—Not later than 180 days 13
after the date of the enactment of this Act, and 14
every 90 days thereafter, the Secretary of State and 15
the Secretary of Homeland Security shall submit a 16
report on the matters described in paragraph (2) 17
to— 18
(A) the Committee on the Judiciary and 19
the Committee on Foreign Relations of the Sen-20
ate; and 21
(B) the Committee on the Judiciary and 22
the Committee on Foreign Affairs of the House 23
of Representatives. 24

(2) MATTERS TO BE INCLUDED .—Each report 1
required by paragraph (1) shall include— 2
(A) the total number of applications that 3
are pending at the end of the reporting period; 4
(B) the average wait-times for all appli-5
cants who are, as of the date of the report, 6
awaiting— 7
(i) employment verification; 8
(ii) a prescreening interview with a re-9
settlement support center; 10
(iii) an interview with U.S. Citizen-11
ship and Immigration Services; and 12
(iv) the completion of security checks; 13
and 14
(C) the number of denials of applications 15
for refugee status, disaggregated by the reason 16
for each such denial. 17
(3) F
ORM.—Each report required by paragraph 18
(1) shall be submitted in unclassified form, but may 19
include a classified annex. 20
(4) P
UBLIC REPORTS.—The Secretary of State 21
shall make each report submitted under this sub-22
section available to the public on the internet website 23
of the Department of State. 24

(g) SATISFACTION OF OTHERREQUIREMENTS.— 1
Aliens granted status under this section as Priority 2 refu-2
gees of special humanitarian concern under the refugee 3
resettlement priority system shall be considered to satisfy 4
the requirements under section 207 of the Immigration 5
and Nationality Act (8 U.S.C. 1157) for admission to the 6
United States. 7
