PROHIBITION ON SALE OR OTHER DISPOSITION OF 1 A FIREARM OR AMMUNITION TO A PERSON 2 CONVICTED OF A VIOLENT MISDEMEANOR. 3 Section 922(d) of title 18, United States Code, is 4 amended in the 1st sentence— 5 (1) in paragraph (10), by striking ‘‘or’’ at the 6 end; 7 (2) in paragraph (11), by striking the period 8 and inserting ‘‘; or’’; and 9 (3) by adding at the end the following: 10 ‘‘(12) has been convicted in any court of a vio-11 lent misdemeanor within the preceding 5 years.’’. 12 SEC. 3. DEFINITION OF VIOLENT MISDEMEANOR. 13 Section 921(a) of title 18, United States Code, is 14 amended by adding at the end the following: 15 ‘‘(38)(A) The term ‘violent misdemeanor’ means an 16 offense that— 17 ‘‘(i) is a misdemeanor under Federal, State, 18 tribal, or local law; and 19 ‘‘(ii) has as an element— 20 ‘‘(I) the use, attempted use, or threatened 21 use of— 22 ‘‘(aa) physical force; or 23 ‘‘(bb) a deadly weapon; 24 ‘‘(II) the intent to cause physical injury; or 25 ‘‘(III) knowingly causing physical injury. 26 VerDate Sep 11 2014 01:24 Apr 11, 2025 Jkt 059200 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2650.IH H2650 kjohnson on DSK7ZCZBW3PROD with $$_JOB 3 •HR 2650 IH ‘‘(B)(i) A person shall not be considered to have been 1 convicted of such an offense for purposes of this chapter, 2 unless— 3 ‘‘(I) the person was represented by counsel in 4 the case, or knowingly and intelligently waived the 5 right to counsel in the case; and 6 ‘‘(II) in the case of a prosecution for an offense 7 described in this paragraph for which a person was 8 entitled to a jury trial in the jurisdiction in which 9 the case was tried, either— 10 ‘‘(aa) the case was tried by a jury, or 11 ‘‘(bb) the person knowingly and intel-12 ligently waived the right to have the case tried 13 by a jury, by guilty plea or otherwise. 14 ‘‘(ii) A person shall not be considered to have been 15 convicted of such an offense for purposes of this chapter 16 if the conviction has been expunged or set aside, or is an 17 offense for which the person has been pardoned or has 18 had civil rights restored (if the law of the applicable juris-19 diction provides for the loss of civil rights under such an 20 offense) unless the pardon, expungement, or restoration 21 of civil rights expressly provides that the person may not 22 ship, transport, possess, or receive firearms.’’. 23 VerDate Sep 11 2014 01:24 Apr 11, 2025 Jkt 059200 PO 00000 Frm 00003 Fmt 6652 Sfmt 6201 E:\BILLS\H2650.IH H2650 kjohnson on DSK7ZCZBW3PROD with $$_JOB 4 •HR 2650 IH SEC. 4. CONFORMING AMENDMENTS. 1 (a) Paragraphs (1)(B)(ii), (2), (4), and (5) of section 2 922(t) of title 18, United States Code, are each amended 3 by striking ‘‘receipt’’ and all that follows through ‘‘sub-4 section (g)’’ and inserting ‘‘knowing sale or disposition of 5 a firearm by the licensee to such other person, or the re-6 ceipt of a firearm by such other person would violate sub-7 section (d), (g),’’. 8 (b) Section 923(d)(1)(B) of such title is amended by 9 striking ‘‘section 922(g) and (n) of this chapter’’ and in-10 serting ‘‘subsection (g) or (n) of section 922, and is not 11 a person to whom the knowing sale or disposition of a 12 firearm or ammunition is prohibited by section 922(d)’’. 13 (c) Section 925A of such title is amended in para-14 graph (2), by inserting ‘‘and to whom the knowing sale 15 or disposition of a firearm was not prohibited pursuant 16 to subsection (d) of such section’’ after ‘‘section 922’’. 17 (d) Section 103 of the Brady Handgun Violence Pre-18 vention Act (34 U.S.C. 40901) is amended— 19 (1) in subsection (e)(1)— 20 (A) in subparagraph (A), by striking ‘‘for 21 whom’’ and all that follows through ‘‘subsection 22 (g)’’ and inserting ‘‘to whom the knowing sale 23 or disposition of a firearm, or for whom receipt 24 of a firearm, would violate subsection (d), (g),’’; 25 and 26 VerDate Sep 11 2014 01:24 Apr 11, 2025 Jkt 059200 PO 00000 Frm 00004 Fmt 6652 Sfmt 6201 E:\BILLS\H2650.IH H2650 kjohnson on DSK7ZCZBW3PROD with $$_JOB 5 •HR 2650 IH (B) in each of subparagraphs (F)(iii)(I) 1 and (G)(i), by striking ‘‘(g)’’ and inserting ‘‘(d), 2 (g),’’; 3 (2) in subsection (g), by striking ‘‘receipt of a 4 firearm by a prospective transferee would violate 5 subsection (g)’’ and inserting ‘‘the knowing sale or 6 disposition of a firearm to, or the possession or re-7 ceipt of a firearm by, a prospective transferee would 8 violate subsection (d), (g),’’; and 9 (3) in subsection (i)(2), by striking ‘‘prohibited 10 by section 922 (g) or (n) of title 18, United States 11 Code or State law, from receiving a firearm.’’ and 12 inserting ‘‘to whom the knowing sale or disposition 13 of, or for whom the possession or receipt of, a fire-14 arm is prohibited by subsection (d), (g), or (n) of 15 section 922 of title 18, United States Code, or State 16 law.’’. 17 (e) Section 101(b) of the NICS Improvement Amend-18 ments Act of 2007 (34 U.S.C. 40911(b)) is amended— 19 (1) in paragraph (1)(A), by striking ‘‘a person 20 is disqualified from possessing or receiving a firearm 21 under subsection (g)’’ and inserting ‘‘the knowing 22 sale or disposition of a firearm to, or the possession 23 or receipt of a firearm by, a person is prohibited 24 under subsection (d), (g),’’; and 25 VerDate Sep 11 2014 01:24 Apr 11, 2025 Jkt 059200 PO 00000 Frm 00005 Fmt 6652 Sfmt 6201 E:\BILLS\H2650.IH H2650 kjohnson on DSK7ZCZBW3PROD with $$_JOB 6 •HR 2650 IH (2) in paragraph (2)(A), by striking ‘‘a member 1 of the Armed Forces involved in such proceeding is 2 disqualified from possessing or receiving a firearm 3 under subsection (g)’’ and inserting ‘‘the knowing 4 sale or disposition of a firearm to, or the possession 5 or receipt of a firearm by, a member of the Armed 6 Forces is prohibited under subsection (d), (g),’’. 7 (f) Section 102 of the NICS Improvement Amend-8 ments Act of 2007 (34 U.S.C. 40912) is amended— 9 (1) in subsection (b)(3)— 10 (A) by inserting ‘‘, or to whom the know-11 ing sale or disposition of a firearm is prohib-12 ited,’’ after ‘‘firearm’’; and 13 (B) by striking ‘‘subsection (g)’’ and in-14 serting ‘‘subsection (d), (g),’’; and 15 (2) in subsection (c)(1)(A), by inserting ‘‘, or is 16 a person to whom the knowing sale or disposition of 17 a firearm is prohibited by subsection (d) of such sec-18 tion’’ before the period. 19 SEC. 5. APPLICABILITY. 20 The amendments made by this Act shall not apply 21 with respect to convictions occurring before the date that 22 is 6 months after the date of enactment of this Act. 23 SEC. 6.
