14	14	To amend the Workforce Innovation and Opportunity Act
15	15	to define employer-directed skills development, and for
16	16	other purposes.
17	17	Be it enacted by the Senate and House of Representa-1
18	18	tives of the United States of America in Congress assembled, 2
19	19	SECTION 1. SHORT TITLE. 3
20	20	This Act may be cited as the ‘‘Improve Employer- 4
21	21	Directed Skills Act’’. 5
22	22	SEC. 2. EMPLOYER-DIRECTED SKILLS DEVELOPMENT. 6
23	23	(a) I
24	24	NTERVIEWEXCEPTION.—Section 134(c)(3)(A) 7
25	25	of the Workforce Innovation and Opportunity Act (29 8
26	26	U.S.C. 3174(c)(3)(A)) is amended— 9

30	30	(1) in clause (i), by striking ‘‘as provided in 1
31	31	clause (ii)’’ and inserting ‘‘as provided in clause (ii) 2
32	32	or (iii)’’; 3
33	33	(2) by redesignating clause (iii) as clause (iv); 4
34	34	and 5
35	35	(3) by inserting after clause (ii) the following: 6
36	36	‘‘(iii) E
37	37	MPLOYER REFERRAL .—A one- 7
38	38	stop operator or one-stop partner shall not 8
39	39	be required to conduct an interview, eval-9
40	40	uation, or assessment of an individual 10
41	41	under clause (i) if such individual— 11
42	42	‘‘(I) is referred by an employer to 12
43	43	receive on-the-job training or em-13
44	44	ployer-directed skills development in 14
45	45	connection with that employer; and 15
46	46	‘‘(II) has been certified by the 16
47	47	employer as being an individual who 17
48	48	is in need of training services to ob-18
49	49	tain unsubsidized employment with 19
50	50	such employer and who has the skills 20
51	51	and qualifications to successfully par-21
52	52	ticipate in the selected program of 22
53	53	training services.’’. 23

57	57	GREEMENT.—Section 134(c)(3) of the Workforce Inno-25

62	62	amended by adding at the end the following: 2
63	63	‘‘(I) E
64	64	MPLOYER-DIRECTED SKILLS DEVEL -3
65	65	OPMENT.—An employer may receive a contract 4
66	66	from a local board to provide employer-directed 5
67	67	skills development to a participant or group of 6
68	68	participants if the employer submits to the local 7
69	69	board an agreement that establishes— 8
70	70	‘‘(i) the provider of the skills develop-9
71	71	ment program, which may be the employer; 10
72	72	‘‘(ii) the length of the skills develop-11
73	73	ment program; 12
74	74	‘‘(iii) the recognized postsecondary 13
75	75	credentials that will be awarded to, or the 14
76	76	occupational skills that will be gained by, 15
77	77	program participants; 16
78	78	‘‘(iv) the cost of the skills development 17
79	79	program; 18
80	80	‘‘(v) the estimated earnings of pro-19
81	81	gram participants upon successful comple-20
82	82	tion of the program; 21
83	83	‘‘(vi) the amount of such cost that will 22
84	84	be paid by the employer, which shall not be 23
85	85	less than the amount specified in subpara-24
86	86	graph (C) of section 3(19); and 25

91	91	to employ the participating individual or 2
92	92	individuals upon successful completion of 3
93	93	the program.’’. 4

95	95	LOBALTECHNICALAMENDMENT.—Title I of 5
96	96	the Workforce Innovation and Opportunity Act (29 U.S.C. 6
97	97	3111 et seq.) is amended by striking ‘‘customized train-7
98	98	ing’’ each place it appears and inserting ‘‘employer-di-8
99	99	rected skills development’’. 9
