A BILL
To amend the Workforce Innovation and Opportunity Act
to define employer-directed skills development, and for
other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Improve Employer- 4
Directed Skills Act’’. 5
SEC. 2. EMPLOYER-DIRECTED SKILLS DEVELOPMENT. 6
(a) I
NTERVIEWEXCEPTION.—Section 134(c)(3)(A) 7
of the Workforce Innovation and Opportunity Act (29 8
U.S.C. 3174(c)(3)(A)) is amended— 9

(1) in clause (i), by striking ‘‘as provided in 1
clause (ii)’’ and inserting ‘‘as provided in clause (ii) 2
or (iii)’’; 3
(2) by redesignating clause (iii) as clause (iv); 4
and 5
(3) by inserting after clause (ii) the following: 6
‘‘(iii) E
MPLOYER REFERRAL .—A one- 7
stop operator or one-stop partner shall not 8
be required to conduct an interview, eval-9
uation, or assessment of an individual 10
under clause (i) if such individual— 11
‘‘(I) is referred by an employer to 12
receive on-the-job training or em-13
ployer-directed skills development in 14
connection with that employer; and 15
‘‘(II) has been certified by the 16
employer as being an individual who 17
is in need of training services to ob-18
tain unsubsidized employment with 19
such employer and who has the skills 20
and qualifications to successfully par-21
ticipate in the selected program of 22
training services.’’. 23

GREEMENT.—Section 134(c)(3) of the Workforce Inno-25

vation and Opportunity Act (29 U.S.C. 3174(c)(3)) is 1
amended by adding at the end the following: 2
‘‘(I) E
MPLOYER-DIRECTED SKILLS DEVEL -3
OPMENT.—An employer may receive a contract 4
from a local board to provide employer-directed 5
skills development to a participant or group of 6
participants if the employer submits to the local 7
board an agreement that establishes— 8
‘‘(i) the provider of the skills develop-9
ment program, which may be the employer; 10
‘‘(ii) the length of the skills develop-11
ment program; 12
‘‘(iii) the recognized postsecondary 13
credentials that will be awarded to, or the 14
occupational skills that will be gained by, 15
program participants; 16
‘‘(iv) the cost of the skills development 17
program; 18
‘‘(v) the estimated earnings of pro-19
gram participants upon successful comple-20
tion of the program; 21
‘‘(vi) the amount of such cost that will 22
be paid by the employer, which shall not be 23
less than the amount specified in subpara-24
graph (C) of section 3(19); and 25

‘‘(vii) a commitment by the employer 1
to employ the participating individual or 2
individuals upon successful completion of 3
the program.’’. 4
(c) G
LOBALTECHNICALAMENDMENT.—Title I of 5
the Workforce Innovation and Opportunity Act (29 U.S.C. 6
3111 et seq.) is amended by striking ‘‘customized train-7
ing’’ each place it appears and inserting ‘‘employer-di-8
rected skills development’’. 9
