2929 NGENERAL.—Section 801(a) of the Federal 2
3030 Food, Drug, and Cosmetic Act (21 U.S.C. 381(a)) is 3
3131 amended— 4
3232 (1) in the seventh sentence, by striking ‘‘as de-5
3333 scribed under subsection (b).’’ and inserting ‘‘as de-6
3434 scribed under subsection (b), or any article refused 7
3535 admission under this section, if the Secretary of 8
3636 Health and Human Services determines that such 9
3737 article presents a significant public health concern.’’; 10

3939 (2) in the eighth, ninth, and tenth sentences, by 12
4040 striking ‘‘drug or device’’ each place it appears and 13
4141 inserting ‘‘drug, device, or other article’’. 14

4343 ROHIBITEDACTS.—Section 301 of the Federal 15
4444 Food, Drug, and Cosmetic Act (21 U.S.C. 331) is amend-16
4545 ed by adding at the end the following: 17
4646 ‘‘(jjj) The unauthorized movement, or introduction or 18
4747 delivery for introduction into interstate commerce, includ-19
4848 ing export, of an article that the Secretary has decided 20
4949 to destroy under the seventh sentence of section 801(a).’’. 21

5151 PPLICABILITY.—The amendments made by sub-22
5252 sections (a) and (b) shall apply to articles beginning on 23
5353 the date that is 180 days after the date of enactment of 24
5454 this Act. 25

5858 (d) REGULATIONS.—The Secretary of Health and 1
5959 Human Services, acting through the Commissioner of 2
6060 Food and Drugs, shall— 3
6161 (1) not later than 90 days after the date of en-4
6262 actment of this Act, finalize such revisions to regula-5
6363 tions as may be necessary to implement the amend-6
6464 ments made by subsections (a) and (b); and 7
6565 (2) ensure that such regulations are consistent 8
6666 with any applicable international agreements. 9
