DESTRUCTION OF CERTAIN REFUSED ARTICLES. 1 (a) I NGENERAL.—Section 801(a) of the Federal 2 Food, Drug, and Cosmetic Act (21 U.S.C. 381(a)) is 3 amended— 4 (1) in the seventh sentence, by striking ‘‘as de-5 scribed under subsection (b).’’ and inserting ‘‘as de-6 scribed under subsection (b), or any article refused 7 admission under this section, if the Secretary of 8 Health and Human Services determines that such 9 article presents a significant public health concern.’’; 10 and 11 (2) in the eighth, ninth, and tenth sentences, by 12 striking ‘‘drug or device’’ each place it appears and 13 inserting ‘‘drug, device, or other article’’. 14 (b) P ROHIBITEDACTS.—Section 301 of the Federal 15 Food, Drug, and Cosmetic Act (21 U.S.C. 331) is amend-16 ed by adding at the end the following: 17 ‘‘(jjj) The unauthorized movement, or introduction or 18 delivery for introduction into interstate commerce, includ-19 ing export, of an article that the Secretary has decided 20 to destroy under the seventh sentence of section 801(a).’’. 21 (c) A PPLICABILITY.—The amendments made by sub-22 sections (a) and (b) shall apply to articles beginning on 23 the date that is 180 days after the date of enactment of 24 this Act. 25 VerDate Sep 11 2014 10:19 Apr 15, 2025 Jkt 000000 PO 00000 Frm 00002 Fmt 6652 Sfmt 6201 E:\BILLS\H2715.IH H2715 mprince on LAP1J3WLY3PROD with $$_JOB 3 •HR 2715 IH (d) REGULATIONS.—The Secretary of Health and 1 Human Services, acting through the Commissioner of 2 Food and Drugs, shall— 3 (1) not later than 90 days after the date of en-4 actment of this Act, finalize such revisions to regula-5 tions as may be necessary to implement the amend-6 ments made by subsections (a) and (b); and 7 (2) ensure that such regulations are consistent 8 with any applicable international agreements. 9 Æ VerDate Sep 11 2014 10:19 Apr 15, 2025 Jkt 000000 PO 00000 Frm 00003 Fmt 6652 Sfmt 6301 E:\BILLS\H2715.IH H2715 mprince on LAP1J3WLY3PROD with $$_JOB
