1717 SECTION 1. SHORT TITLE. 3
1818 This Act may be cited as the ‘‘Abortion Funding 4
1919 Awareness Act of 2025’’. 5
2020 SEC. 2. REQUIRED REPORTING OF MEDICAID PAYMENTS 6
2121 TO ABORTION PROVIDERS. 7
2222 (a) I
2323 NGENERAL.—Not later than 60 days after the 8
2424 end of the first fiscal year ending after the date of enact-9
2525 ment of this Act and each fiscal year thereafter, each 10

2929 State that makes a Medicaid payment from Federal funds 1
3030 during the fiscal year for any items or services furnished 2
3131 by an abortion provider shall— 3
3232 (1) submit to the Secretary a report on all such 4
3333 payments; and 5
3434 (2) publish the report on a public internet 6
3535 website of the State. 7

3737 EPORTDESCRIBED.—The report under sub-8
3838 section (a) shall, with respect to a State that makes a 9
3939 Medicaid payment from Federal funds during the fiscal 10
4040 year for any items or services furnished by an abortion 11
4141 provider, include the following: 12
4242 (1) With respect to each such payment, each of 13
4343 the following: 14
4444 (A) A specification of the amount of the 15
4545 payment. 16
4646 (B) A specification of the purposes for 17
4747 which the payment was made. 18
4848 (C) A comparison of the amount of the 19
4949 payment with the amount of any such payment 20
5050 to the provider involved in any prior fiscal year. 21
5151 (2) A specification of the number of abortions 22
5252 performed during the fiscal year by the provider in-23
5353 volved and the gestational age with respect to each 24
5454 such abortion. 25

6161 EPORT TOCONGRESS.—Not later than 90 days 3
6262 after the end of each fiscal year described in subsection 4
6363 (a), the Secretary shall submit to the Committee on En-5
6464 ergy and Commerce of the House of Representatives and 6
6565 to the Committee on Finance of the Senate, and publish 7
6666 on a public internet website of the Department of Health 8
6767 and Human Services, a report that— 9
6868 (1) contains the reports submitted pursuant to 10
6969 subsection (a) for the fiscal year; and 11
7070 (2) includes a summary of the reports. 12

7272 EFINITIONS.—In this section: 13
7373 (1) A
7474 BORTION.—The term ‘‘abortion’’ means 14
7575 the use or prescription of any instrument, medicine, 15
7676 drug, or any other substance or device— 16
7777 (A) to intentionally kill the unborn child of 17
7878 a woman known to be pregnant; or 18
7979 (B) to intentionally terminate the preg-19
8080 nancy of a woman known to be pregnant, with 20
8181 an intention other than— 21
8282 (i) after viability, to produce a live 22
8383 birth and preserve the life and health of 23
8484 the child born alive; or 24
8585 (ii) to remove a dead unborn child. 25

8989 (2) ABORTION PROVIDER.—The term ‘‘abortion 1
9090 provider’’ means an entity that— 2
9191 (A) performs (or refers an individual for) 3
9292 an abortion; or 4
9393 (B) controls, is controlled by, or is under 5
9494 common control with, an entity described in 6
9595 subparagraph (A). 7

9797 EDICAID PAYMENT FROM FEDERAL 8
9898 FUNDS.—The term ‘‘Medicaid payment from Fed-9
9999 eral funds’’ means a payment for which there is 10
100100 Federal financial participation under title XIX of 11
101101 the Social Security Act. 12

103103 ECRETARY.—The term ‘‘Secretary’’ means 13
104104 the Secretary of Health and Human Services. 14

106106 TATE.—The term ‘‘State’’ has the mean-15
107107 ing given the term for purposes of title XIX of the 16
108108 Social Security Act. 17

111111 RITYACT.—Section 1902(a) of the Social Security Act 19
112112 (42 U.S.C. 1396a(a)) is amended— 20
113113 (1) by striking ‘‘and’’ at the end of paragraph 21

115115 (2) by striking the period at the end of para-23
116116 graph (87) and inserting ‘‘; and’’; and 24
