A BILL 
To require States to report information on Medicaid 
payments to abortion providers. 
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Abortion Funding 4
Awareness Act of 2025’’. 5
SEC. 2. REQUIRED REPORTING OF MEDICAID PAYMENTS 6
TO ABORTION PROVIDERS. 7
(a) I
NGENERAL.—Not later than 60 days after the 8
end of the first fiscal year ending after the date of enact-9
ment of this Act and each fiscal year thereafter, each 10

State that makes a Medicaid payment from Federal funds 1
during the fiscal year for any items or services furnished 2
by an abortion provider shall— 3
(1) submit to the Secretary a report on all such 4
payments; and 5
(2) publish the report on a public internet 6
website of the State. 7
(b) R
EPORTDESCRIBED.—The report under sub-8
section (a) shall, with respect to a State that makes a 9
Medicaid payment from Federal funds during the fiscal 10
year for any items or services furnished by an abortion 11
provider, include the following: 12
(1) With respect to each such payment, each of 13
the following: 14
(A) A specification of the amount of the 15
payment. 16
(B) A specification of the purposes for 17
which the payment was made. 18
(C) A comparison of the amount of the 19
payment with the amount of any such payment 20
to the provider involved in any prior fiscal year. 21
(2) A specification of the number of abortions 22
performed during the fiscal year by the provider in-23
volved and the gestational age with respect to each 24
such abortion. 25

(3) A specification of the method of abortion 1
used. 2
(c) R
EPORT TOCONGRESS.—Not later than 90 days 3
after the end of each fiscal year described in subsection 4
(a), the Secretary shall submit to the Committee on En-5
ergy and Commerce of the House of Representatives and 6
to the Committee on Finance of the Senate, and publish 7
on a public internet website of the Department of Health 8
and Human Services, a report that— 9
(1) contains the reports submitted pursuant to 10
subsection (a) for the fiscal year; and 11
(2) includes a summary of the reports. 12
(d) D
EFINITIONS.—In this section: 13
(1) A
BORTION.—The term ‘‘abortion’’ means 14
the use or prescription of any instrument, medicine, 15
drug, or any other substance or device— 16
(A) to intentionally kill the unborn child of 17
a woman known to be pregnant; or 18
(B) to intentionally terminate the preg-19
nancy of a woman known to be pregnant, with 20
an intention other than— 21
(i) after viability, to produce a live 22
birth and preserve the life and health of 23
the child born alive; or 24
(ii) to remove a dead unborn child. 25

(2) ABORTION PROVIDER.—The term ‘‘abortion 1
provider’’ means an entity that— 2
(A) performs (or refers an individual for) 3
an abortion; or 4
(B) controls, is controlled by, or is under 5
common control with, an entity described in 6
subparagraph (A). 7
(3) M
EDICAID PAYMENT FROM FEDERAL 8
FUNDS.—The term ‘‘Medicaid payment from Fed-9
eral funds’’ means a payment for which there is 10
Federal financial participation under title XIX of 11
the Social Security Act. 12
(4) S
ECRETARY.—The term ‘‘Secretary’’ means 13
the Secretary of Health and Human Services. 14
(5) S
TATE.—The term ‘‘State’’ has the mean-15
ing given the term for purposes of title XIX of the 16
Social Security Act. 17
(e) C
ONFORMINGAMENDMENTS TO SOCIALSECU-18
RITYACT.—Section 1902(a) of the Social Security Act 19
(42 U.S.C. 1396a(a)) is amended— 20
(1) by striking ‘‘and’’ at the end of paragraph 21
(86); 22
(2) by striking the period at the end of para-23
graph (87) and inserting ‘‘; and’’; and 24

(3) by inserting after paragraph (87) the fol-1
lowing: 2
‘‘(88) provide for the submission of reports in 3
accordance with section 2 of the Abortion Funding 4
Awareness Act of 2025.’’. 5
