18	18	To prohibit the Internal Revenue Service from providing
19	19	firearms and ammunition to its employees, and for other
20	20	purposes.
21	21	Be it enacted by the Senate and House of Representa-1
22	22	tives of the United States of America in Congress assembled, 2
23	23	SECTION 1. SHORT TITLE. 3
24	24	This Act may be cited as the ‘‘Why Does the IRS 4
25	25	Need Guns Act’’. 5
26	26	SEC. 2. DEFINITIONS. 6
27	27	For purposes of this Act: 7

31	31	(1) AMMUNITION.—The term ‘‘ammunition’’ 1
32	32	has the same meaning given such term under section 2
33	33	921(a)(17) of title 18, United States Code. 3

35	35	OMMISSIONER.—The term ‘‘Commis-4
36	36	sioner’’ means the Commissioner of Internal Rev-5
37	37	enue. 6
38	38	(3) F
39	39	IREARM.—The term ‘‘firearm’’ has the 7
40	40	same meaning given such term under section 8
41	41	921(a)(3) of title 18, United States Code. 9
42	42	SEC. 3. PROHIBITION ON USE OF FUNDS. 10
43	43	(a) I
44	44	NGENERAL.—Notwithstanding any other provi-11
45	45	sion of law, none of the funds authorized to be appro-12
46	46	priated or otherwise made available for any fiscal year 13
47	47	may be obligated or expended by the Commissioner to pur-14
48	48	chase, receive, or store any firearm or ammunition. 15
49	49	(b) E
50	50	FFECTIVEDATE.—This section shall take effect 16
51	51	on the date which is 120 days after the date of enactment 17
52	52	of this Act. 18
53	53	SEC. 4. TRANSFER OF FIREARMS AND AMMUNITION. 19
54	54	Not later than the date which is 120 days after the 20
55	55	date of enactment of this Act, the Commissioner shall 21
56	56	transfer to the Administrator of General Services— 22
57	57	(1) any firearms owned by, or under the control 23
58	58	of, the Internal Revenue Service; and 24

62	62	(2) any ammunition owned by, or under the 1
63	63	control of, the Internal Revenue Service. 2
64	64	SEC. 5. SALE OF FIREARMS. 3
65	65	(a) I
66	66	NGENERAL.—Not later than the date which is 4
67	67	30 days after the date on which the transfer described 5
68	68	in section 4 has been completed, the Administrator of Gen-6
69	69	eral Services shall— 7
70	70	(1) initiate the sale or auction of any firearms 8
71	71	described in paragraph (1) of such section to li-9
72	72	censed dealers (as defined in section 921(a)(11) of 10
73	73	title 18, United States Code); and 11
74	74	(2) initiate the auction of any ammunition de-12
75	75	scribed in paragraph (2) of section 4 to members of 13
76	76	the general public. 14

78	78	ROCEEDS.—Any proceeds from the sale or auc-15
79	79	tion of property described in subsection (a) shall be depos-16
80	80	ited in the general fund of the Treasury for the sole pur-17
81	81	pose of deficit reduction. 18
82	82	SEC. 6. ADMINISTRATION OF CRIMINAL INVESTIGATIONS 19
83	83	BY ATTORNEY GENERAL. 20
84	84	(a) I
85	85	NGENERAL.—With respect to the administra-21
86	86	tion and enforcement of— 22
87	87	(1) any of the criminal provisions of the inter-23
88	88	nal revenue laws, 24

92	92	(2) any other criminal provisions of law relating 1
93	93	to internal revenue for the enforcement of which the 2
94	94	Secretary of the Treasury, as of the date of enact-3
95	95	ment of this Act, was responsible, or 4
96	96	(3) any other law for which the Secretary of the 5
97	97	Treasury, as of the date of enactment of this Act, 6
98	98	delegated investigatory authority to the Internal 7
99	99	Revenue Service, 8
100	100	such administration and enforcement shall be performed 9
101	101	by or under the supervision of the Attorney General. 10
102	102	(b) P
103	103	ERFORMANCE OF TRANSFERREDFUNCTIONS.— 11
104	104	The Attorney General may make such provisions as the 12
105	105	Attorney General determines appropriate to authorize the 13
106	106	performance by any officer, employee, or agency of the De-14
107	107	partment of Justice of any function transferred to the At-15
108	108	torney General under this section. 16

110	110	RANSFER OFAUTHORITIES, FUNCTIONS, PER-17
111	111	SONNEL, ANDASSETS TO THE DEPARTMENT OF JUS-18
112	112	TICE.—Notwithstanding any other provision of law, there 19
113	113	are transferred to the Department of Justice the authori-20
114	114	ties, functions, personnel, and assets of the Criminal In-21
115	115	vestigation Division of the Internal Revenue Service, 22
116	116	which shall be maintained as a distinct entity within the 23
117	117	Criminal Division of the Department of Justice, including 24
118	118	the related functions of the Secretary of the Treasury. 25
